A man from North Carolina filed a knee implant lawsuit in February against Zimmer, a medical device company that made his allegedly defective knee implant, which has reportedly been a great source of suffering.
The text of the defective knee implant lawsuit states that plaintiff Warren N. of North Carolina received a Zimmer knee implant in November 2010. Though his knee implant lawsuit does not go into details, it alleges that the Warren suffered complications from his Zimmer knee implant that also caused economic damages.
Widespread knee replacement lawsuits have been filed in recent years. These knee replacement lawsuits allege that knee implants like the ones made by Zimmer readily fail and are defective in design, leading to serious suffering for patients with knee implants.
So many knee implant lawsuits have been filed that the court system has had to created a process called multidistrict litigation, or MDL, to organize them. In MDLs, similar lawsuits are grouped together. Some of these lawsuits are then selected for bellwether trials and are used to test the waters on legal arguments and create precedents that can apply to the other knee implant lawsuits in the MDL.
The outcome of the bellwether trials may lead defendants to agree to settlements for the remainder of the lawsuits in an MDL. Since knee replacement lawsuits make similar allegations and hinge on similar evidence, they are ideal for large-scale knee implant MDLs. However, since there are several different companies that made knee implants currently facing knee replacement lawsuits, there currently several knee implant MDLs in progress.
Defective knee implant lawsuits allege that defects in knee implant design have led to premature failure and loosening of the joint, as well as serious pain, inflammation, and trouble moving the joint.
Allegations in knee implant lawsuits also often allege that the knee implants’ alleged defective design contribute to bone, nerve, and muscular damage and may even promote infection.
Knee replacement lawsuits typically seek to recoup the cost of medical care, lost wages, legal fees and other costs allegedly linked to defective knee implants.
Some knee implant lawsuits also seek punitive damages, which is additional money tacked onto lawsuit awards, designed to punish offenders and discourage further misconduct.
The Knee Replacement Lawsuit is Case No. 0089, filed within the larger MDL In Re: Zimmer Nexgen Knee Implant Products Liability Litigation, MDL No. 2272, in the U.S. District Court for the Northern District of Indiana, South Bend Division.
In general, knee replacement lawsuits are filed individually by each plaintiff and are not class actions.
