A new class action lawsuit alleges JustAnswer automatically enrolls consumers into unwanted subscriptions after they pay for a single question to be answered by an expert.
Plaintiff Linda Larson claims JustAnswer fails to adequately disclose to consumers that they will be enrolled into a monthly subscription and charged a recurring fee after paying for a single question to be answered.
“Consumers are often charged for renewal purchases without their consent or knowledge,” Larson argues in the JustAnswer class action.
Larson wants to represent a class of Texas consumers who paid JustAnswer to answer a question and were automatically enrolled into a monthly subscription, and a specific subclass of Texas consumers who did so with a debit card.
Larson claims JustAnswer is guilty of conversion and negligent misrepresentation and unjust enrichment and of violating the Electronic Funds Transfer Act, Texas Deceptive Trade Practices-Consumer Protection Act, California Automatic Renewal Law, California Consumers Legal Remedies Act and California Unfair Competition Law.
JustAnswer failed to provide adequate disclosures about subscription, class action alleges
Larson claims she contacted JustAnswer in February 2022 while attempting to resolve charges related to her son’s Microsoft video game. Larson argues she was unaware that JustAnswer enrolled her in a monthly subscription and charged her a recurring fee of $46.
Larson claims she did not realize JustAnswer was the source of the charges for years due to the billing descriptor appearing as “Tech Geek,” causing her to believe the charges were associated with Geek Squad or another legitimate technology service provider.
“When Plaintiff Larson eventually realized her mistake and discovered that the charges were in fact coming from JustAnswer, she spent years trying to have the recurring charges removed,” the JustAnswer class action lawsuit alleges.
Larson claims JustAnswer’s failure to provide adequate disclosures about the subscription resulted in her paying more than $1,000 in unauthorized recurring fees over a three-year period.
In a similar case, Amazon was sued over claims it used sophisticated subscription traps to steer consumers into enrolling in Prime and then made it difficult for them to cancel. The company later agreed to pay $2.5 billion to settle the Federal Trade Commission’s allegations.
