A Johnson and Johnson mesh lawsuit alleging serious device defects, and that the pharmaceutical giant cut corners when testing these products, recently came to a close.
In the closing arguments, an attorney for the plaintiff told jurors that Ethicon had failed to adequately study the risks of its transvaginal mesh products prior to releasing it onto the market in 2003. Despite the alleged lack of proper testing, the Johnson and Johnson mesh lawsuit notes that the medical device manufacturer spent millions of dollars in marketing expenses for the mesh implant.
“There was nothing to stop them from doing a clinical trial except for greed,” argued the attorney.
According to the Johnson and Johnson mesh lawsuit, the plaintiff, Susan M., suffered from serious complications after implantation with a Johnson and Johnson mesh device in 2008, meant to treat her SUI (or stress urinary incontinence). Within a year and a half of her device implantation, however, Susan says she began suffering from serious complications associated with the device, including pain during sex.
At that point, doctors allegedly discovered that a part of the mesh device had actually eroded through her vaginal wall. This required surgery to remove and alleviate the problem. Unfortunately, even after the device was removed, Susan says she has continued to suffer from frequent urinary tract infections and is often bedridden. She also reports suffering from chronic pain, and is no longer able to have sex with her husband due to the severity of the pain.
If you or someone you love has suffered from side effects of a defective vaginal mesh sling device from Boston Scientific or other manufacturer, you may be able to file a lawsuit.
Basics of Vaginal Mesh
Patients who suffer from stress urinary incontinence (SUI) or pelvic organ prolapse (POP)—which often occur after menopause, hysterectomy, or childbirth—may be implanted with a vaginal mesh device.
Vaginal mesh is typically considered to be a less invasive surgical procedure than abdominal insertion of mesh. However, despite the widespread use of these devices, more and more patients are reporting suffering from serious TVT complications as a result of implantation with vaginal mesh. Indeed, thousands of women have filed transvaginal mesh lawsuits so far.
Two of the main complications associated with vaginal mesh are mesh erosion and organ perforation. Mesh erosion occurs when the implant breaks apart, and can then pass through the vaginal wall, leading to problems like severe pain, bleeding infection, and even nerve damage. Organ perforation can occur as a result, cutting into the bladder and other organs with its jagged edge.
So far, hundreds of thousands of patients have been implanted with a vaginal mesh device, and may be at risk of these complications.
