Band-Aid PFAS class action lawsuit overview: 

  • Who: Plaintiff Sharnay Moultrie filed a class action lawsuit against Johnson & Johnson and Kenvue Inc. 
  • Why: Moultrie claims Johnson & Johnson and Kenvue manufactured and sold Band-Aid products containing dangerous PFAS. 
  • Where: The Band-Aid class action lawsuit was filed in New Jersey federal court. 

Johnson & Johnson manufactured and sold Band-Aid products containing per- and polyfluoroalkyl substances, or PFAS, chemicals that are dangerous to human health, a new Band-Aid class action lawsuit alleges. 

Plaintiff Sharnay Moultrie’s class action lawsuit claims the Band-Aid products are unfit for their intended purpose due to the presence of the so-called “forever chemicals.” 

“Defendants’ Products poses a health and safety risk due to the presence of PFAS in the Products,” the Band-Aid class action says. 

The Band-Aid brand is owned by Kenvue Inc., which separated itself from Johnson & Johnson last year after previously operating as the company’s healthcare division, according to the Band-Aid PFAS class action. 

The presence of PFAS in Band-Aid products, meanwhile, was discovered during product testing conducted in a laboratory certified by the Environmental Protection Agency, according to the Band-Aid class action. 

Moultrie wants to represent a nationwide class and California subclass of consumers who purchased Band-Aid products during the statute of limitations period. 

Johnson & Johnson fails to disclose PFAS content, Band-Aid class action claims

Moultrie argues Johnson & Johnson fails to disclose that its Band-Aid products contain PFAS and, subsequently, consumers purchase them under the “reasonable belief” they do not contain synthetic chemicals that could adversely affect their health. 

“Unbeknownst to consumers, the Products are unfit for their intended purpose because they contain PFAS, ‘forever chemicals,’ which are dangerous to human health,” the Band-Aid class action says. 

Moultrie claims Johnson & Johnson and Kenvue are guilty of unjust enrichment, fraudulent concealment and breach of implied and express warranty, and of violating California’s False Advertising Law, Unfair Competition Law and Song-Beverly Consumer Warranty Act

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, statutory and punitive damages for herself and all class members. 

A pair of consumers filed a similar class action lawsuit against Brumis Imports earlier this month over claims the company manufactured Brooklyn Steel nonstick cookware containing PFAS
