da Vinci Surgical SystemIntuitive Surgical Inc., the makers of the da Vinci Surgical System, recalled parts of the device, citing concerns over injuries. This recall comes as the medical equipment company faces robot surgery lawsuits over alleged injuries suffered from the da Vinci system.

The da Vinci Surgical System is a surgical tool for laparoscopic surgery. This is a  type of surgery in which surgeons use smaller incisions, typically less than an inch, and small, flexible tools to perform the bulk of the surgery inside the patient’s body. Laparoscopic surgery offers benefits over traditional surgery. Since it is less invasive, it causes less scarring, and tends to have shorter recovery times than regular surgery.

However, several serious concerns have emerged over the da Vinci Surgical System. First, the cost of the device. It costs $2 million, and requires several hundreds of thousands of dollars’ worth of maintenance every year. Critics have suggested that this high cost makes hospitals more eager to “get their money’s worth,” encouraging them to promote robotic surgery over traditional laparoscopic surgery. In a similar vein, some studies have indicated robotic surgery does not have better outcomes than traditional laparoscopic surgery.

Several robot surgery lawsuits have alleged that the da Vinci Surgical System is associated with an increased risk of complications compared with traditional laparoscopic surgery. It is alleged that the device can cause complications either through nicks to the internal organs, or even electrical burns associated with unshielded electronics.

The March recall involved a component called a cannula. Cannulae are small tubes used to introduce components of the da Vinci System for laparoscopic surgery. According to the Intuitive recall notice, the da Vinci recall was response to a report that a faulty cannula caused a small injury to a patient during a surgery. The notice stated that the patient required no additional medical care to correct the problem. It was subsequently revealed that roughly one in 200 cannulae from that lot of components were defective.

Intuitive is facing robot surgery lawsuits over allegations that the da Vinci System has caused serious complications. These allegations may take the form of a group lawsuit like multidistrict litigation (MDL) or a class action lawsuit. Group lawsuits like MDLs and class action lawsuits allow a group of people to seek legal redress against a single defendant over similar alleged harm. Class action lawsuits typically start as a group lawsuit, while MDLs start as individual suits that are later condensed into a single coordinated legal action.

  1. Suzzanne M Schermerhorn says:

Needle became unscrewed and fell into my abdomen. I was taken out of the OR and into X-ray to find it. That night I began to bleed internally and was taken into emergency surgery and was opened wide because I began to bleed internally. During that stay I had pneumonia, collapsed lung, got MRSA. Many surgeries and hospital visits later I am still in pain. Sometimes it’s extreme muscle spasms. Sometimes it’s a sharp stabbing pain. And this was just the beginning of the nightmare I’ve been living through for months and months
