Inno Supps class action lawsuit overview:
- Who: Plaintiff Bruce Gray filed a class action lawsuit against The Clean Supps LLC, doing business as Inno Supps.
- Why: Gray claims Inno Supps misled consumers with fake discounts and illegal auto-renewal schemes.
- Where: The class action lawsuit was filed in California federal court.
Natural supplement company Inno Supps misled customers with fake discounts and illegal auto-renewal schemes, a new class action lawsuit alleges.
Plaintiff Bruce Gray’s class action lawsuit claims Inno Supps deceived customers by advertising fictitious discounts and enrolling them in automatic renewal subscriptions without proper disclosure.
“Inno Supps enrolled Plaintiff into an automatic renewal subscription without providing the clear and conspicuous disclosures required by California law,” the Inno Supps class action says.
Gray wants to represent a California class of consumers who purchased a product or service from Inno Supps as part of an automatic renewal plan or continuous service offer within the past four years where the product was purchased at a discount from a higher price and who have not received a refund or credit for their purchase, along with subclasses of one or the other.
Class action says Inno Supps failed to clearly explain subscription terms
Gray argues Inno Supps violated California’s Automatic Renewal Law (ARL) and caused consumers to receive unauthorized charges by failing to clearly and conspicuously explain its subscription terms.
The class action lawsuit also argues Inno Supps advertised products as being on sale from inflated reference prices when, in reality, the company never sold the products at the advertised regular prices, misleading consumers into thinking they were getting a good deal.
“Companies like Inno Supps drastically benefit from employing a false reference pricing scheme and experience increased sales,” the Inno Supps class action states.
In addition to allegedly violating the ARL, Gray claims Inno Supps is in violation of California’s Unfair Competition Law and False Advertising Law and the Federal Trade Commission Act.
The plaintiff demands a jury trial and requests injunctive and declaratory relief and an award of actual, consequential, punitive and statutory damages for himself and all class members.
A pair of consumers filed a similar class action lawsuit against nutrition supplement company Puritan’s Pride in 2017 over claims it ran a “Buy One Get One Free” promotion that did not actually help customers save money.
