Across the country, many IVC filter patients who suffered complications are working rigorously with a specialized blood clot filter attorney to move through the intense litigation process.
According to a status update in the IVC filter litigation, blood clot filter lawyers are reviewing potential IVC filter lawsuits filed against manufacturing company Cook and C.R. Bard.
Patients working with a blood clot filter attorney are not expected to pay any money unless a settlement is recovered due to all the cases being handled under a contingency fee.
This means that patients who suffered IVC filter complications can file their claim with a lot of help without the worry of paying large upfront legal fees.
Each of the affected patients allege that the Cook and Bard IVC filters have caused serious injuries, claiming the devices fractured or broke apart inside the inferior vena cava. As the largest vein in the body, the inferior vena cava is a major part of the body’s circulation system.
IVC filters are small cage like metal devices that are implanted into the vein when blood clots are formed in either the legs or pelvis and cannot be treated with anticoagulants.
When these blood clots resolved, the temporary models can be later removed or patients can opt for the permanent models to stay in place.
However the temporary models allegedly have been made by inferior components which reportedly cause them to eventually break apart inside the inferior vena cava.
Overview of IVC Filter Complications
The FDA warned against Cook and Bard IVC Filters in August 2010, stating that temporary models could cause serious problems if not removed after the blood clot is resolved.
At least 900 adverse event reports have been submitted to the FDA regarding IVC filter complications, with the most common problems including the device breaking apart and migrating away from the inferior vena cava.
In May 2014, the FDA issued an updated safety warning regarding temporary IVC filters.
The agency recommended the device to be removed between 29 days to 54 days after implantation, depending on when the blood clot is resolved.
By removing the temporary IVC filters, the chances of injury are decreased. In the wake of the FDA’s warning, patients began seeking out their own blood clot filter lawyer to seek compensation.
Patients who seek out a blood clot filter attorney, are seeking compensation for medical expenses related to the IVC filter complications. Currently these legal experts are continuously reviewing IVC filter lawsuits, to determine eligibility for further litigation.
Claims for both Bard and Cook IVC filters have been consolidated into a multidistrict litigation (MDL) under which claims alleging similar claims are joined together to streamline the litigation process.
By consolidating lawsuits, legal resources are conserved and conflicting rulings from different judges can be avoided.
Potential claimants should contact a specialized blood clot filter attorney, to determine eligibility for an IVC filter lawsuit.
In general, IVC filter lawsuits are filed individually by each plaintiff and are not class actions.
