Thousands of Infuse bone graft lawsuits may rest on the outcome of a Medtronic class action lawsuit filed against the medical device manufacturer by its own investors.
Earlier this year, investors filed a lawsuit against Medtronic Inc. claiming the company fraudulently concealed problems associated with its Infuse bone graft product from investors and consumers alike, allegedly injuring thousands of Infuse patients who could then potentially turn around and file Medtronic lawsuits.
According to news reports, if the jury finds against Medtronic for fraudulent concealment and other Infuse bone graft class action lawsuit charges, it bodes well for Infuse bone graft victims who have filed Infuse complications lawsuits.
However, a previous Medtronic class action lawsuit also filed by the company’s investors was settled for about $85 million with the company admitting no wrongdoing.
Plaintiff Allen is an Infuse bone graft recipient awaiting the outcome of the investors’ Medtronic class action lawsuit. Allen, now 46, underwent two Infuse bone graft implantation surgeries, one five years ago and another two years later to correct the same spine issue. However, allegedly due to Infuse bone graft side effects, Allen now suffers from a bone growing outside the original Infuse bone graft implantation site.
Allen claims he suffers from more pain now than before undergoing Infuse bone graft spinal fusion surgery. The plaintiff further alleges he suffers from muscle spasms and has trouble swallowing, which has allegedly led to episodes of choking while drinking and eating.
According to Allen’s attorney, he will have to wait at least six weeks to find out if his Infuse bone graft lawsuit will go forward in court, meaning his Infuse bone graft claims may be dependent on the ruling in the Medtronic class action lawsuit.
The Minneapolis federal judge presiding over the investors’ Medtronic class action lawsuit will allow the plaintiffs’ legal counsel to investigate the alleged Infuse side effect cover-up involving several Medtronic officials and company retained medical professionals. The Infuse class action lawsuit further alleges that Medtronic CEO William Hawkins manipulated Infuse bone graft research to further disguise the dangerous product side effects.
Infuse Bone Graft System
The Infuse bone graft system is a synthetic protein designed, manufactured, and distributed by Medtronic. The Infuse protein is mixed with bovine collagen and then injected into a surgical area, which facilitates and encourages bone growth of affected joints and bones.
