Influencer marketing class action lawsuits overview:

  • Who: Consumers recently filed class action lawsuits against Celsius Holdings, Shein, Revolve Group and multiple “influencers.” 
  • Why: The class action lawsuits argue Celsius, Shein and Revolve failed to disclose that influencers were paid to promote their products.

Consumers recently filed class action lawsuits against Celsius Holdings, Shein, Revolve Group and multiple “influencers” over claims the companies failed to disclose that the influencers were being paid to promote products. 

The class action lawsuits allege the companies violated the FTC Act and various state consumer protection laws. 

Complaints involving influencer marketing have become more common amid an increase in influencer advertising, growth of consumer awareness, heightened scrutiny from the Federal Trade Commission and developing legal precedent. 

The class action lawsuits highlight the importance of transparency in how companies and brands advertise their products and services, and how a lack of transparency can potentially injure consumers financially. 

Celsius used misleading influencer marketing scheme to inflate prices, class action claims

A class action lawsuit filed in January alleges Celsius Holdings and three social media influencers failed to disclose the influencers’ financial relationship with the energy drink brand.

Plaintiff Mariana Dubreu claims Celsius and the influencers — Devon Barbara, Erika Wheaton and Emily Tanner — engaged in a scheme to artificially inflate the prices of Celsius products by having the influencers promote the energy drinks without disclosing they were paid to do so.

“Relying on the undisclosed and misleading advertising, Plaintiff and the Class Members purchased products and paid a premium, while the products proved to be of a much lower value than the price paid,” the Celsius class action says.

Dubreu wants to represent a nationwide class and California subclass of consumers who purchased Celsius products in the United States from January 2021 to the present.

Shein class action says company failed to disclose influencers were paid to promote products

A class action lawsuit filed in February alleges Shein and a group of social media influencers engaged in a “deceptive, unfair and misleading” promotion of Shein products by failing to disclose the influencers were being paid to endorse them.

A group of consumers argues that Shein and the influencers engaged in a scheme to make it appear as if the influencers were endorsing the products as disinterested consumers, rather than paid sponsors. 

The group further claims they and other consumers relied on the influencers’ endorsements and misleading advertising when they purchased Shein products and paid a premium for them, only to find that they were of a much lower value than the price paid.

“Without having the chance to try the clothes, millions of consumers, including the class representatives and class members, relied exclusively on the advice of social media influencers,” the Shein class action says.

The group wants to represent a nationwide class and California, Virginia, Pennsylvania, Illinois, and District of Columbia subclasses of consumers who purchased Shein products online relying on misleading marketing practices and Influencers from June 24, 2019, to present.

Revolve clothing failed to disclose its relationship with social media influencers, class action claims

A class action lawsuit filed last month alleges Revolve Group misleads consumers by failing to disclose its relationship with a number of social media influencers.

Plaintiff Ligia Negreanu argues Revolve’s marketing strategy involves influencers promoting its clothes without disclosing they were compensated for doing so.

Negreanu claims she and other consumers were misled into purchasing Revolve clothes at inflated prices due to these undisclosed endorsements.

“Plaintiff and the Class Members purchased products from REVOLVE and paid a premium, while the REVOLVE products proved to be of a lower value than the price paid,” the Revolve class action says.

Negreanu wants to represent a nationwide class and Florida subclass of consumers who purchased Revolve clothing products during the class period.

      I have brought a lot of clothing and other items from shein looking at influencers saying the products are good then receive them and they mediocre. Also, I use revolve as my primary payment.
