A woman has filed an industrial asbestos exposure lawsuit on behalf of her deceased husband against several named defendants, including CBS Corporation. The lawsuit says the man suffered sustained asbestos-related lung injuries and death because of inhalation.
The woman, plaintiff Sandra L., has filed the industrial asbestos exposurelawsuit on behalf of the late Gustav L. in California federal court.
According to the industrial asbestos exposure lawsuit, Gustav suffered sustained asbestos-related lung injuries because of inhalation of asbestos fibers he endured at work. Gustav died Aug.18, 2017. Sandra says that Gustav developed the asbestos-related lung disease and death by inhaling asbestos fibers and handling products that contained asbestos owned by his employers.
The release of the harmful and carcinogenic asbestos fibers which Gustav inhaled caused his development for serious lung disease, the industrial asbestos exposure lawsuit states.
According to the industrial asbestos exposure lawsuit, Gustav’s “exposure to asbestos and asbestos-containing products caused severe and permanent injury to the decedent, including, but not limited to breathing difficulties and/or other lung injury or damage, and ultimately, death.”
Gustav was diagnosed with mesothelioma in July 2017.
The industrial asbestos exposure lawsuit is filed on multiple counts including negligence, product liability, wrongful death, among others.
Overview: Industrial Asbestos Exposure
According to the National Cancer Institute (NCI), asbestos has been used and mined commercially in North America since the late 1800s. It is the name given to six minerals that naturally occur in the environment as bundles of fibers.
Asbestos has had wide commercial and industrial applications and has been used in a variety of settings. Some of the reasons it has been widely used are because of asbestos’ ability to be resistant to heat and fire, not conduct electricity, and being resistant to chemicals.
Asbestos has been used in a number of industries as its use also greatly increased during World War II. The building and construction industries have extensively used asbestos within plastics and cement for use in sound absorption, roofing, insulation, and fireproofing. Other industries have included the automotive industry as asbestos has been used within clutch pads and brake shoes. It has also been used in adhesives, paints, coatings, and floor tiles.
However, in 1989, the U.S. Environmental Protection Agency (EPA) enacted a broad ban on uses of asbestos. Asbestos has been classified by the U.S. Department of Health and Human Services (HHS), the International Agency for Research on Cancer (IARC), and the EPA, as a substance that causes cancer known as a human carcinogen.
According to the NCI, there is also sufficient evidence provided by the IARC that asbestos causes mesothelioma. The Mayo Clinic defines mesothelioma as a “type of cancer that occurs in the thin layer of tissue that covers the majority of your internal organs (mesothelium).” The most common kind of mesothelioma is, pleural mesothelioma, which is cancer that affects the tissue of the lungs.
Signs and symptoms of pleural mesothelioma, according to the Mayo Clinic include:
- Painful coughing
- Shortness of breath
- Chest pain below the rib cage
- Unexplained weight loss
- Lumps of tissue under the skin on your chest
