HP Inc. has been slapped with a class action lawsuit alleging its website is not accessible to blind individuals.

Plaintiff Daniel Crosby’s class action lawsuit claims HP’s website contains “persistent accessibility barriers” that prevent blind individuals from accessing its services.

Crosby wants to represent a nationwide class of legally blind individuals who attempted to access HP’s website and were denied equal access to its services due to persistent digital accessibility barriers.

Crosby claims HP’s website and its affiliated platforms contain missing alternative text, broken ARIA references, unlabeled buttons and inaccessible navigation menus that prevent blind users from independently engaging with its digital services.

“Plaintiff attempted to independently navigate the product configuration pages for both devices using NVDA,” the HP class action lawsuit says. “However, he encountered persistent access barriers that rendered the site unusable.”

Class action: HP failed to implement lasting accessibility improvements

Crosby argues HP has failed to implement lasting accessibility improvements to its website despite having been sued for similar violations of the Americans with Disabilities Act (ADA) in 2020.

The plaintiff claims HP is guilty of violating the ADA, Section 504 of the Rehabilitation Act of 1973, the New York State Human Rights Law, the New York State Civil Rights Law and the New York City Human Rights Law.

Crosby demands a jury trial and requests declaratory and injunctive relief and an award of compensatory damages for himself and all class members.

Earlier this year, HP asked an Illinois federal judge to dismiss a class action lawsuit claiming it maintains a printer cartridge monopoly, arguing that customers failed to show a firmware update unlawfully blocked the use of third-party replacement cartridges.
