Another lawsuit has been added to a DePuy ASR MDL, alleging that the medical device manufacturer’s hip implant caused serious complications.
The Kansas plaintiff, Gemma W., was implanted with a DePuy ASR hip implant in April 2008. Unfortunately, after receiving the implant, Gemma says she began suffering from a few DePuy ASR hip implant complications. She experienced extensive pain and discomfort, the lawsuit in the DePuy ASR MDL claims, as well as dislocation, corrective surgeries, and loss of enjoyment of life.
Because of these injuries, Gemma’s hip implant was explanted on June 12, 2015. Years passed between the implantation and removal of the hip device. According to the DePuy ASR MDL lawsuit, Gemma did not know about the connection between her injuries and the device itself until DePuy recalled its hip implant from the market and she became aware of the link.
Gemma also notes in her hip implant lawsuit as do others in the DePuy ASR MDL that these surgeries increased her risk, caused further pain and, of course, incurred medical expenses. The monetary losses are apparently not yet over: according to the DePuy ASR MDL lawsuit, Gemma will continue being treated and monitored for these conditions.
The DePuy ASR MDL lawsuit was filed on multiple counts, including negligence, defective design, manufacturing defect, failure to warn, breach of express and implied warranties, and punitive damages.
DePuy ASR Hip Implant Basics
Thousands of Americans undergo hip replacement surgery each year. So far, over half a million Americans have been implanted with a hip implant device. A large portion of these implants are metal-on-metal devices, such as the DePuy ASR hip implant.
However, despite the popularity of the DePuy ASR hip implant, a growing number of patients are coming forward with complaints of serious complications after implantation. DePuy has been hit with thousands of lawsuits over injuries linked with its hip implant device.
The U.S. Food and Drug Administration (FDA) issued a recall of the DePuy ASR hip implant back in August 2010. Around 93,000 patients were affected by the recall.
Thousands of Americans may still be implanted with the device, meaning they are still at risk of the complications warned about by the FDA. Some patients have begun filing lawsuits against DePuy to help compensate for their injuries.
Pursuing a DePuy ASR MDL
Those who have suffered injuries or been forced to undergo a hip revision surgery after being implanted with a DePuy device may be able to join the DePuy ASR MDL, or multidistrict litigation, for compensation. Nearly 8,000 DePuy lawsuits have been filed over the hip implant device in total. The first group of lawsuits reached a DePuy ASR settlement of $600,000.
