A South Carolina woman recently filed a lawsuit against Atrium Medical, alleging that its device caused serious hernia mesh failure problems.
The plaintiff, Julianne M., was implanted with a hernia mesh device from Atrium on Aug. 5, 2015. Unfortunately, after implantation with the device, Julianne began experiencing serious complications. Due to hernia mesh failure, Julianne was forced to undergo a revision surgery to remove the mesh device. That surgery took place on June 5, 2017—less than two years after the initial device implantation occurred.
The specific device involved in Julianne’s hernia mesh failure lawsuit is the Atrium C-Qur Mesh V-Patch. Maria and many others like her have alleged suffering from hernia mesh failure that has caused severe or long-lasting injuries. Some patients, like Maria, choose to pursue litigation over their hernia mesh failure.
Maria filed her hernia mesh failure lawsuit on Oct. 3, 2017 in the U.S. District Court for the District of New Hampshire. The hernia mesh failure lawsuit was filed on multiple counts, including design defect, manufacturing defect, failure to warn, defective product, breach of express and implied warranties, fraudulent concealment, negligent misrepresentation, gross negligence, and several others.
Hernia Mesh Device Basics
Hernia repair mesh like the Atrium C-Qur mesh involved in this lawsuit is a popular method of repairing damage done from a hernia. Hernia repair mesh is a kind of woven material used to reinforce a weak area or patch a hole. Even though hernia repair mesh is meant to fix damage, patients can actually suffer from serious complications due do the hernia repair mesh itself.
For some patients, hernia mesh complications may appear immediately after the surgery itself, but for others, such symptoms may not appear for weeks, months, or even years afterward.
Serious hernia repair mesh problems are surprisingly common. Indeed, between one and eight percent of patients implanted with hernia repair mesh end up developing some kind of infection related to their mesh.
Hernia Mesh Failure
Patients may experience a number of serious problems due to implantation with a hernia mesh device like the C-Qur Mesh V-Patch, including hernia mesh failure. Patients have reported experiencing, among others, the following hernia mesh failure problems:
- Chronic pain
- Hernia recurrence
- Rejection of the mesh
- Infection
- Device migration
- Scarring
- Inflammation
- Organ adhesion
- Erosion
- Tissue and nerve damage
- Death
Some problems, such as device migration, can later lead to more serious complications like infection, adhesion, and device failure. In many cases, side effects are severe enough that patients are forced to undergo revision surgery to remove the device completely.
