A widow has filed a GranuFlo wrongful death lawsuit against Fresenius USA Inc., alleging that the kidney dialysis additive was responsible for the heart attack that took her husband’s life.
Ludella McDole filed her GranuFlo lawsuit on March 11, claiming that the dialysis drug lead her late husband R.J. Broadnax to have a heart attack that proved to be fatal. As part of her GranuFlo complaint, she’s claiming wrongful death under Alabama state law.
McDole will join the GranuFlo MDL, where hundreds of similar cases are consolidated. With this route, she’s suing Fresenius Medical Care Holdings, Inc. and all its subsidiaries. The GranuFlo MDL is similar to a GranuFlo class action lawsuit in that multiple plaintiffs are suing the same defendants. They will all share in the same pre-trial discovery but will be awarded unique settlements based on their individual damages.
Fresenius Medical Care has been under severe scrutiny ever since a 2009 internal memo was leaked which revealed that key employees may have had information that GranuFlo was more dangerous than originally marketed. This memo was sent to a few doctors at a few Fresenius centers and detailed information that showcased the drugs may cause more cardiac events than previously noted. It was never meant to be seen by anyone besides the recipients. This came after other studied suggested that patients given GranuFlo had a higher chance of experiencing a cardiac event.
In the case of McDole, her husband was being treated at a dialysis center which wasn’t owned by Fresenius. Fresenius sold the drugs to numerous competing dialysis centers.
In Broadnax’s case, he was getting dialysis at Wilcox Dialysis in Camden, Alabama. The majority of GranuFlo victims have cardiac events while undergoing dialysis. In this case, it was fatal.
Members of the GranuFlo MDL and GranuFlo class action lawsuit claim that they were never warned about the full GranuFlo risks. Likewise, physicians and others in the medical community say they were unaware of the full GranuFlo complications, too. This has helped build the foundation for a growing GranuFlo class action lawsuit that is welcoming new members at an alarming rate.
The Alabama widow is suing Fresenius and citing numerous counts including strict liability failure to warn, negligent design, negligence, negligent misrepresentation, breach of warranties, fraud, wrongful death and wrongful death under Alabama laws.
GranuFlo Recall Leads to Class Action Lawsuit
For years, Fresenius was a company that both operated the most kidney dialysis centers in the United States and manufactured complementary drugs which leveled the bicarbonate levels in the bloodstream for dialysis patients. These two drugs, GranuFlo and NaturaLyte, have since been linked to an increased risk of cardiac events including heart attacks and death.
There have been so many GranuFlo lawsuits filed after the GranuFlo recall that they’ve been consolidated into a single litigation similar to a class action lawsuit, called multidistrict litigation or MDL, also known as a Mass Tort. In a GranuFlo class action lawsuit, all the class members can join onto the same lawsuit as others with similar injuries. In a Mass Tort, everyone files individual lawsuits. Pharmaceutical drug and medical device lawsuits are usually treated as a Mass Tort, as opposed to a class action lawsuit, because the injuries can vary, making a single class unrealistic.
Mass Tort litigation allows one attorney or a group of attorneys the ability to represent clients with similar injuries as well as pool together resources that can be used and shared by all clients just like in a class action lawsuit.
However, unlike a GranuFlo class action lawsuit, there is no cap as to how much the settlement award can be in the GranuFlo MDL.

Me pusieron dos beses las aguja mal eso me causó una infección ,ahora tengo un hoyo en el brazo,cuando fui al hospital por la infección lo que me dieron antibiótico y me dejaron ir para la casa y arriba de la infección me estaban dando diálisis y nunca me mandaron al hospital de nuevo tú ve que ir al hospital por mi cuenta por no aguantaba el dolor en el hospital duraron tanto para ver qué tenía que la carne donde está la infección se murió estuvieron que mocharla y por esa diligencia médica de ellos tengo tremendo hoyo en el brazo
