A new class action lawsuit accuses Go Car Wash of deceptively enrolling customers into automatic renewal payment plans for its car wash services.
Plaintiff Aaron Rodriguez filed the class action complaint against Go Car Wash on March 18 in California federal court, alleging violations of state and federal consumer laws.
Rodriguez argues Go Car Wash failed to clearly disclose the automatic renewal terms of its membership plans, leading customers to unknowingly sign up for recurring payments.
“Plaintiff and other consumers have been deceived by Defendant’s actions, and consequently have been deceived into signing up for an automatically renewing payment plan,” the Go Car Wash class action lawsuit says.
Rodriguez wants to represent a California class of consumers who were enrolled in Go Car Wash’s membership program and charged at least one renewal fee, and a nationwide class of consumers who were debited on a recurring basis without written authorization or after revoking authorization.
Go Car Wash failed to disclose automatic renewal terms, class action alleges
Rodriguez claims Go Car Wash failed to clearly disclose that its memberships would automatically renew each month, both online and at its physical locations.
The company also allegedly made it difficult or impossible for customers to cancel their memberships and even charged customers after they had canceled, the Go Car Wash class action lawsuit says.
Rodriguez claims he was charged $34.99 after canceling his membership despite being assured by a Go Car Wash employee that it had been canceled.
“Defendant’s scheme and practice is uniform across its car wash locations,” the Go Car Wash class action lawsuit says, adding that the allegedly deceptive scheme violates the California Automatic Renewal Law, Electronic Funds Transfer Act and California consumer protection laws.
Rodriguez demands a jury trial and requests an order requiring Go Car Wash to pay damages, restitution and declaratory and injunctive relief.
Go Car Wash is among the companies facing class action lawsuits over unauthorized subscriptions. In December, 1-800-Flowers was also hit with a class action alleging it has been illegally charging customers recurring fees for its Celebrations Passport membership program without proper consent or notification.
