A new class action lawsuit alleges GlassesUSA Inc. secretly shared consumer data with TikTok despite promising to protect users’ privacy.
Plaintiff Miguel Esparza claims GlassesUSA allowed TikTok to spy on consumers who visited its website, glassesusa.com, by using a tracking pixel to gather personal information without their consent.
The GlassesUSA class action lawsuit alleges violations of the California Invasion of Privacy Act (CIPA), which prohibits the unauthorized installation of trap-and-trace devices.
“Defendant falsely promised website visitors that it would protect their privacy, but then secretly monetized their personal information by enabling TikTok to spy on those visitors,” the GlassesUSA class action lawsuit says.
TikTok spying particularly invasive, GlassUSA lawsuit alleges
Plaintiff Esparza claims GlassesUSA’s website contains a tracking pixel created by TikTok that collects data on visitors, including device information, geographic location, browsing history and even phone numbers and email addresses.
The TikTok pixel allegedly begins collecting information as soon as a user lands on the site, without any notice or consent, and sends it to TikTok’s servers.
The GlassesUSA class action lawsuit argues that the TikTok pixel is particularly invasive because it captures sensitive information, such as usernames, passwords, credit card details and health data, and can then transfer that to locations around the world, including China and Russia.
“By sharing plaintiff’s and class members’ personal and de-anonymized data with TikTok, Defendant effectively ‘doxed’ them to America’s most formidable geopolitical adversary,” the GlassesUSA class action states.
Esparza wants to represent a California class of consumers whose personal information was shared with TikTok or other third parties by GlassesUSA without their informed consent.
The plaintiff demands a jury trial and requests statutory damages, attorney fees and injunctive relief to prevent GlassesUSA from continuing its alleged unlawful practices.
In 2024, Patagonia faced a class action lawsuit alleging the outdoor apparel company used hidden spy trackers to capture and log sensitive information from its email subscribers in an alleged violation of Arizona’s Telephone, Utility and Communication Service Records Act.

Not sure how this works when someone from CA files, but I do think the entire country should be eligible, as surely, this horrible deceipt impacts the entire country of unsuspecting consumers, like us in AZ. Shiesters!!
