
GM Peeling Paint Class Action Lawsuit Overview:

Four owners of General Motors (GM) SUVs and trucks are suing the automaker, saying the paint on their vehicles is peeling and flaking off, and that they should be recalled.
In a class action lawsuit filed against GM by owners of 2015 to 2019 model year full-size truck and SUV models, the plaintiffs allege that there is a defect in the paint and clear coat on their vehicles, CarComplaints reports.
The plaintiffs are looking to represent drivers who have a Chevrolet Tahoe, Chevrolet Suburban, Chevrolet Silverado, GMC Yukon, GMC Yukon XL or GMC Sierra model years 2015-2019.
They say that the paint on their vehicles peels and delaminates without any external or environmental influence as the paint and clear coat were not able to bond properly due to their opposing chemical properties.
As a result, the plaintiffs say GM must recall all affected vehicles and pay owners and lessees for their losses.
“GM should properly repair all of the Class Vehicles immediately, offer rescission to the Class by repurchasing their Class Vehicles for their full cost, reimburse the lessees of the Class Vehicles the monies they have paid toward their leases, recall all defective vehicles that are equipped with the defective paint and cease and desist from marketing, advertising, selling and leasing the Class Vehicles,” the lawsuit states.
GM Aware of Paint Defects, Did Not Tell Customers
GM was aware of the paint defects and “failed to provide truthful information” regarding the defect, the lawsuit alleges. Despite knowing of the issue, the automaker continued to market and sell the vehicles.
This class action lawsuit was filed by Florida GM customers Tom Riley, Heather Shrum and Gary Ambrose, along with Tennessee GM customer Sherry Kilburn.
In 2021, GM took the top spot for most vehicles recalled according to data from the National Highway Traffic Safety Administration. A total of 8 million GM vehicles were determined to be potentially affected by recall reports.
