Gaspari “Novedex XT” Class Action Settlement

Gaspari Nutrition, Inc. has reached a class action lawsuit settlement over allegations it violated consumer protection laws by making false statements about the body building supplement “Novedex XT.” As a result, consumers who purchased Novedex XT between 2006 and 2011 may receive up to $20 per bottle purchased.The Novedex XT settlement will resolve a class action lawsuit, entitled James Keller v. Gaspari Nutrition, Inc., that alleges improper statements were contained on the label and in advertisements for Novedex XT, and that such statements violate consumer protection laws and were fraudulent. Gaspari denies all allegations of wrongdoing and denies it caused harm to consumers, but offered to pay $1 million in refunds and free products to resolve the litigation.
Class Members of the Novedex XT class action settlement include anyone who purchased Novedex XT for personal use between November 2, 2006 and October 3, 2011.
As a Class Member of the Novedex XT settlement, you can choose to receive one of the following three benefits:
If you have a valid receipt or credit card statement showing you purchased Novedex XT, you will receive a check for $20 for each bottle of Novedex XT purchased during the Class Period.
If you do not have a valid receipt or credit card statement, but sign a sworn affirmation under penalty of perjury that you purchased Novedex XT, you will receive a check for $10 for each bottle of Novedex XT purchased during the Class Period, up to a maximum of four bottles.
Viridex XT Alternative: As an alternative to monetary compensation, Class Members may elect to receive a free bottle of Viridex XT, a testosterone enhancing supplement also manufactured by Gaspari.
To receive your settlement check or free bottle of Viridex XT from the class action settlement, you must submit a Claim Form along with the required supporting documentation either online at www.NovedexXTSettlement.com or postmarked to the Settlement Administrator no later than January 16, 2012.
