Fry’s Electronics Dragon Naturally Speaking Class Action Lawsuit

Dragon Naturally Speaking softwareAn angry Fry’s Electronics customer has filed a class action lawsuit against Fry’s and Nuance Communications claiming the companies sell a $250 Nuance Communication voice-recognition software package called Dragon Naturally Speaking that doesn’t work. According to the irate Plaintiff, “Fry’s likes people to buy its products, but they hate customers.”

Plaintiff Michael Nathan alleges in the class action lawsuit that Nuance falsely advertises that its Dragon Naturally Speaking software can recognize speech with 99% accuracy. Nathan says he was willing to fork over the large sum to purchase the software because of this promise and because Fry’s employees told him he could return the software for a full refund within 30 days if it didn’t work.

According to the Dragon Naturally Speaking class action lawsuit, Nathan spent more than two weeks at 3 to 5 hours a day reading materials and articles to Dragon Software to try and get it to recognize his voice, to no avail.

Fed up, Nathan returned the Nuance software to Fry’s, which refused to refund his money because a store supervisor told him, “It was against the law to accept open software.”

Nathan is seeking restitution and punitive damages for a proposed class of all similar Fry’s customers who purchased Nuance Dragon Naturally Speaking software. His class action lawsuit is alleging breach of warranty, false advertising, fraudulent inducement, breach of contract, unfair competition, and consumer laws violations.

    Dragon ver 13 still does not work in 2018, at least not with windows 10. In 2010 they actually had a version that did work with window XP. No response from the company and no refunds for an unworkable piece of software. If everyone did software this bad, and had customer service this bad, there would be no computer industry today. Since the others posts are from 2012, clearly nothing has changed in 6 years and this defective product is still being peddled without any fix. I requested any info on a fix from the company. No response at all.

    The product(Dragon Version11) never worked and tech support was impossible to reach. I’m sorry that I ever bought it.

    The talk dragon never worked for me.I bought it hoping to write a book but the product never worked

    This never did work. I have an old edition several years old, I even updated it, not worth the effort.
