From You Flowers class action lawsuit overview:

Online flower delivery service From You Flowers LLC uses a bait-and-switch pricing scheme to trick customers into paying more for floral arrangements, a new class action lawsuit alleges.

Plaintiffs Trevor Walterlakes and Kimberley Mahabal filed the class action complaint against From You Flowers on Jan. 29 in New York federal court, alleging violations of state and federal consumer protection laws.

According to the lawsuit, From You Flowers systematically cheats consumers out of millions of dollars annually by employing a deceptive and illegal bait-and-switch pricing scheme.

The company allegedly adds previously undisclosed “surprise fees” to every product purchased right before the buyer finalizes the transaction. These fees, often labeled as “delivery fees,” are not disclosed to consumers at any point prior to the final stage of the transaction and are actually a hidden part of the total price a consumer must pay for each product purchased via its e-commerce platform, the lawsuit says.

Consumers lured by fake low prices, lawsuit claims

From You Flowers lures consumers into purchasing floral arrangements from its website by advertising artificially low prices for its service while hiding the amount of surprise fees that it charges for each product, the lawsuit states.

“Specifically, Defendant advertises misleadingly low prices that do not include added fees. Only at the latest point in checkout does Defendant, for the first time, list a total amount that includes the surprise fees, after consumers have already engaged in a lengthy, multi-step process,” the lawsuit explains.

The plaintiffs seek to represent anyone in the United States who purchased a floral arrangement or other gift delivery from From You Flowers. 

They are suing for violations of state and federal consumer protection laws and seeking certification of the class action, damages, restitution, fees, costs and a jury trial.

In December 2024, two consumers filed a class action lawsuit against 1-800-Flowers, alleging the company has been illegally charging customers recurring fees for its Celebrations Passport membership program without proper consent or notification.

    My issue with the bait and switch this company does is I ordered an arrangement online and receive a completely different product, which just happened to me 2 days ago. I would love to hear from this lawyer about filing a similar suit in CA or if the NY one covers all states.

    I own a retail florist, and I wish they would go after ALL of the “clearing house” floral services, (AVAS, Just Flowers, etc) They are happy to take the consumer’s money, keep anywhere from 25 – 40% for themselves, and give the receiving florist a bare minimum starting price to fill the order. Buyers beware of these services! Their website might advertise a dozen roses for $40, trying to draw the customer in, but you wont find an actual florist that sells them for that price. Then they’re calling you back to ask for more $$$. Always shop local, and make sure your florist is a REAL shop with excellent ratings!

    November 2024 I ordered the “Holy Light Crystal Cross” bouquet for a funeral. I bought it because of the beautiful crystal cross. They overcharged me AND when the bouquet arrived there was no crystal cross in the bouquet but a skimpy little wooden cross stuck in the bouquet. I complained to them about the price overcharge and the cross. They never acknowledged the cross complaint and refunded me the difference from the website price ($8.67) and charged me a same day delivery fee plus the regular delivery fee which I never agreed to. I will never use them again. They have also changed the name of the bouquet now to Sweet Serenity Crystal Cross Bouquet on their website.
