A Louisiana man has filed a mesothelioma compensation lawsuit against his former employer claiming they were responsible for his asbestos mesothelioma.
Plaintiff Robert R. has filed this mesothelioma compensation lawsuit against Dow Corporation. He alleges that they should be held liable for “substantial exposure to asbestos and asbestos-containing products sold, distributed, applied, removed, used, manipulated and/or maintained at the locations described” in his mesothelioma compensation lawsuit.
Robert claims that he was exposed to asbestos products while he worked for Dow in different places in Louisiana and in other parts of the United States.
He says that he was “exposed, on numerous occasions, to asbestos and/or asbestos-containing products produced, manufactured, installed, removed, maintained, sold, and/or distributed by [Dow] and, in so doing, has inhaled great quantities of asbestos fibers, and as a result has suffered injuries caused by such exposure.”
When Robert worked at Aber, Inc. (a part of Dow), according to this asbestos mesothelioma lawsuit he was exposed to asbestos via pipe insulation, block insulation, insulating cement, finishing cement, asphaltic mastic, weather coating, insulation fittings, blankets, felt, tape, jackets, vessel covers, board, roofing, siding, duct, gaskets and packing.
When he worked at Georgia Pacific, he claims he was exposed to asbestos through his handling of an asbestos-containing joint compound and such other asbestos-containing products. Robert’s asbestos mesothelioma lawsuit also alleges that during his time at Union Carbide, he was exposed to asbestos through asbestos fibers and other asbestos-containing products. These named subsidiaries of Dow are only a few on the list of places of exposure at which Robert was employed.
What is Asbestos Mesothelioma?
Asbestos is a mineral that is mined in the earth. It has been commercially used for decades because of its flame retardant qualities as well as its heat resistance. When it is left undisturbed, asbestos is not dangerous to humans. However, when it is disturbed, it can be harmful and even deadly.
When asbestos fibers are breathed in, those fibers cannot be expelled and lodge in the lungs and surrounding tissue. Over time, these tiny asbestos fibers cause inflammation which can be the precursor to cancer.
Cancer of the lining of the lungs is called mesothelioma. Mesothelioma is almost exclusively caused by asbestos exposure.
Asbestos mesothelioma can be deadly to a person who is exposed, but it oven does not develop until long after the person has been exposed. For example, an employee could be exposed to asbestos as a young man in his twenties, but then not develop asbestos mesothelioma until his sixties.
Asbestos mesothelioma is not the only deadly condition caused by asbestos exposure. A person regularly exposed to asbestos can develop asbestosis or asbestos lung cancer.
According to this asbestos mesothelioma lawsuit, “When inhaled or otherwise ingested, asbestos, shortly after inhalation or ingestion, causes irreparable and progressive damage that can manifest itself as asbestos-related pleural diseases, such as asbestosis, lung cancer and mesothelioma, and other diseases and injuries.”
Robert believes that his employers should have warned him about the possibility of asbestos mesothelioma and other related problems. He alleges that the defendants actively concealed this information, and therefore were responsible for his injuries.
He believes that his injuries include asbestos mesothelioma, as well as “increased susceptibility to one of the foregoing diseases and other illnesses; and … mental anguish associated with the preceding conditions, and with the fear of developing the preceding conditions.”
