Ford Motor Company is facing a class action lawsuit alleging it concealed a known transmission defect in 2011-2013 Ford Fiesta vehicles and 2012-2014 Ford Focus vehicles.

Plaintiffs Julie Dawn Cordaro and Jennifer A. Cordaro allege they purchased a new 2012 Ford Focus vehicle in October 2011.

According to the Ford class action lawsuit, their Focus had a DPS6 PowerShift Transmission, which the plaintiffs claim is defective.

“The PowerShift Transmission is neither a traditional manual transmission, nor a typical automatic transmission, but is a computerized ‘automated manual’ transmission,” the plaintiffs explain in the Ford transmission defect class action lawsuit.

“Ford marketed and sold its PowerShift Transmission as an automatic transmission that offered the ‘best of both worlds’ combining a manual transmission’s fuel economy with an automatic transmission’s ease of operation and shift quality.”

According to the Ford class action lawsuit, the PowerShift Transmission is a set of computerized manual transmissions. The system allegedly uses two clutches to engage and disengage the engine and transmission.

Unlike other “automated manual” transmissions on the market, which use clutches coated in oil, the PowerShift Transmission clutches do not include oil pumps and operate “dry,” the Ford class action lawsuit says.

The plaintiffs claim that the PowerShift Transmission is defectively designed and/or manufactured.

According to the Ford class action lawsuit, the transmission “consistently slips, bucks, kicks, jerks, harshly engages, has premature internal wear, sudden acceleration, delay in downshifts, delayed acceleration, difficulty stopping the vehicle, and, eventually, premature transmission failure.”

The Ford transmission defect can also cause unsafe conditions because they affect the driver’s ability to control the vehicle’s speed, acceleration and deceleration, the plaintiffs say.

According to the Ford PowerShift Transmission class action lawsuit, Ford knew or should have known about the transmission defect since at least 2010 based on non-public, internal data including early consumer complaints, dealership repair orders, testing, and technical service bulletins provided to Ford dealerships and authorized repair facilities.

The plaintiffs say they took their vehicle to an authorized Ford repair facility on multiple occasions between 2013 and 2015 over complaints the transmission was making strange noises and freezing in gear.

Each repair was completed under warranty and the plaintiffs were repeatedly promised that the vehicle was safe to drive, the Ford class action lawsuit says.

The Ford transmission defect class action lawsuit asserts claims for breach of express warranty, breach of implied warranty, fraudulent inducement, concealment, intentional misrepresentation and negligent misrepresentation.

The plaintiffs are seeking rescission of the purchase contract, restitution, damages, prejudgment interest, punitive damages, attorneys’ fees and costs, and other relief the court deems proper.

The Ford class action lawsuit was initially filed on July 16 in the Superior Court of California for the County of San Diego and was removed to California federal court on Aug. 16.

The plaintiffs are represented by Steve Mikhov and Amy Morse of the Knight Law Group LLP.

    was moving my car in a gas station parking lot and went to stop the car to go in reverse and the breaks went to the floor and I pushed them about five times and still no breaks. I hit a concrete column and air bags didn’t deploy and the airbag lights were blinking on and off and speedometer needle was going crazy. Officer went to assist with moving the car to a curbside and in neutral the car was trying to go forward then when it was put in park it continued to try to go forward. We were not on a hill, it was flat in the parking lot. If this would have happened on the main roads my son, nephew and myself could have been hurt and if I had hit someone else they could have been hurt as well. I know have a adjusting checking the vehicle and a mechanics shop as well. Before this happened I had absolutely no warning.

    I just totalled mine and my airbags didnt deploy and when I drove it nothing but transmission issues

      I bought a 2012 Ford Focus a couple of years ago from a private dealer and my transmission went out and I had to replace the forks in the transmission. It cost me over $2000.00 dollars. My car has about 189,000 miles on it. Can I still participate in this class action suit. I was never notified of this.

    This lawsuit must include 2007 focus’ as well! Over $5000+ in tows, ford SVC, transmission, rental car charges, etc. ford owes me. Only about 47k – 50k miles. Yet over the six years of warranty. Although I remember dealer saying it was 100,000/10 year. Either way, ford is WRONG!

    2013 Ford fiesta was never notified of a recall, took it in Sept and I’m 5,000 over the warranty extension however my vehicle is not that old,I have three kids Ford won’t help me with the failing vehicle

    I have the ford fiesta 2012 and they never sent me a recall or anything about this transmission being bad is there anything I can do now??

      i called my local dealer the other day after a recall that had to due with something related to fuel, anyways i was shocked to hear that my stuttering transmission which they denied to fix months prior is now being fixed for free since ford has lost the lawsuit, so give them a call!

    I have a 2012 Focus (titanium – automatic), and have been presented with a $1500 Transmission bill (clutch plate needs replacing). It has 200ks on it. Do I still have options?

    My step mother passed and gave me her 2012 ford fiesta, it is having transmission problem and only has 30k miles on it. I am unsure of any times it may have been taken in but are we allowed to get this fixed without paying for it?
