A new class action lawsuit accuses Florida’s Natural Growers of falsely advertising its orange juice products as being made exclusively from Florida oranges despite them containing juice from Mexico and Brazil.
Plaintiff Patricia Donadio claims Florida Natural prominently displays a United States flag on the front label of its orange juice products next to a statement that the brand is “Owned By Florida Farmers.”
“The Florida Representations collectively represent that the Products are made exclusively of premium Florida orange juice,” the Florida’s Natural class action lawsuit says.
Donadio argues Florida’s Natural intentionally misleads consumers into believing its orange juice products are made exclusively from Florida oranges because consumers believe they taste better and are of better quality than imported orange juice.
Florida’s Natural allegedly began blending OJ with Mexican, Brazilian juice in 2022
Donadio claims Florida’s Natural began blending its orange juice products with juice from Mexico and Brazil in May 2022 in an effort to keep its market share and meet consumer demand amid a decline in Florida’s citrus groves.
“Every package of the Products misleads consumers into believing the Products are made exclusively of Florida orange juice,” the Florida’s Natural class action lawsuit says.
Donadio alleges Florida’s Natural is guilty of fraud and violating New York General Business Law. She demands a jury trial and requests declaratory and injunctive relief and an award of compensatory and statutory damages for herself and all class members.
Earlier this year, consumers filed lawsuits against several major brands, including Goya Foods, PepsiCo and the Pepsi Lipton Tea Partnership, alleging they used false “Made in USA” labeling. The lawsuits come as President Donald Trump imposes tariffs as part of what his administration calls an effort to boost domestic manufacturing.
