A new Byte class action lawsuit alleges the company falsely marketed its aligners as being safe and effective.
Plaintiff Paula J. Phillips filed the class action complaint against Straight Smile LLC, doing business as Byte, and Dentsply Sirona Inc. on March 7 in Florida federal court, alleging violations of state and federal consumer laws.
Byte and Dentsply falsely advertised their Byte Aligner Systems and Impression Kits as affordable solutions for crooked or malformed smiles, the class action lawsuit claims.
The companies targeted financially vulnerable consumers with promises of affordable and accessible oral care, but the products were proven to be ineffective and dangerous, the plaintiff argues.
Phillips claims the companies lacked essential feedback loops to timely advise regulators and the public of adverse incidents involving their products.
The companies abruptly suspended sales and marketing of the Byte Aligner Systems and Impression Kits in October 2024, citing a review of regulatory requirements, the lawsuit says.
Despite this, Phillips claims the companies have failed to compensate customers who purchased the products based on false and deceptive representations.
Class action alleges Byte aligners caused pain, bleeding
Phillips purchased a Byte Aligner System and Impression Kit in April 2024 and began experiencing pain and bleeding in her mouth the following month, the lawsuit says. She stopped using the product and requested a refund, but Byte’s website advised that no refunds were available.
The plaintiff seeks to represent anyone in Florida who bought a Byte Aligner System and Impression Kit. She is suing for violations of Florida’s Deceptive and Unfair Trade Practices Act, breach of warranties and breach of contract and seeks certification of the class action, damages, fees, costs and a jury trial.
In 2023, the creators of the Invisalign teeth correction system allege in a lawsuit that competitor SmileDirectClub falsely advertises its affiliation with real dentists and orthodontists.

I started and finished with byte. I have a gap in my front teeth. It closed then opened back up and now one of my front teeth are loose! They refuse to give refunds and now I’m back at square 1 with a loose tooth.
