A new Fairlife class action lawsuit alleges the milk company falsely advertises its products as being made with milk from cows that are well cared for.
The plaintiffs filed the class action lawsuit against Fairlife LLC, The Coca-Cola Co., Mike McCloskey, Sue McCloskey and Select Milk Producers Inc. on Feb. 26 in California federal court, alleging violations of state and federal consumer laws.
According to the Fairlife animal cruelty class action lawsuit, Fairlife advertises that cows used to produce milk for its products are particularly well-treated and not abused or neglected in any way. The company also claims that its production methods are environmentally sustainable, and its packaging is recyclable.
However, the plaintiffs allege that these claims are false and misleading because Fairlife sources its milk from farms where cows and calves are systematically abused and mistreated. They also claim that Fairlife’s production methods are not environmentally sustainable and its packaging is not recyclable.
Fairlife’s anti-cruelty, sustainability claims false, lawsuit alleges
The Fairlife milk class action lawsuit alleges that advertising and marketing practices have driven up the price of the company’s products and increased its sales and profitability.
The plaintiffs argue that consumers are willing to pay a premium for milk products made from humanely treated cows and produced sustainably. They allege that Fairlife’s false advertising led them to pay more for the company’s products than they otherwise would have.
Class members are seeking damages for themselves and other consumers who purchased Fairlife products and an injunction to stop Fairlife from making the alleged false claims.
In 2022, Fairlife agreed to a $21 million class action settlement for the same allegations of animal cruelty. Defendants in the case included The Coca-Cola Co. and Fair Oak Farms.
