Monster says in a new energy drink lawsuit that VPX Sports is selling Bang energy drink with false claims, telling consumers that Bang allegedly can treat a range of diseases that actually have no cure.
Monster believes that these allegedly misleading claims are sending consumers to purchase Bang without having all of the facts.
In recent years, federal regulators have paid more attention to any product that includes health claims either on the label or in other marketing materials, cracking down on those supplements, drinks, foods, and other products in health and wellness that provide potentially misleading information.
Consumers who purchased the Bang Energy Drink, marketed by VPX Sports, after seeing promotional materials that indicated that the drug was capable of curing conditions like Parkinson’s or Alzheimer’s, may be interested in learning about Monster’s energy drink lawsuit.
Energy Drink Claims
Monster is a competitor of VPX Sports. Monster states in their energy drink lawsuit that VPX Sports has actively promoted their Bang energy drink as being able to help with Alzheimer’s disease and other forms of dementia, or even to reverse mental retardation.
Monster Beverage Corporation, after hearing of these claims, filed a lawsuit in a California District Court, arguing that the company is using deceptive advertising and marketing in violation of California laws.
There are a few different complaints listed in Monster’s energy drink lawsuit, including alleged violations of false advertising, unfair competition, trade libel and more.
The suit claims that Monster will likely to continue to suffer damages to their goodwill and their business, in addition to the loss of sales and profits, for the alleged wrongful acts carried out by VPX Sports.
The energy drink lawsuit filed by Monster says that the owner of VPX Sports, who also refers to himself as the Chief Scientific Officer, has used videos on Instagram and YouTube that suggest that the ingredient inside the Bang product is 20 times more effective at reaching the brain when compared with other types of creatine.
The Bang Energy Drink lawsuit challenges the claims made by VPX Sports such as that it could cure Parkinson’s disease, Huntington’s disease, other forms of dementia, Alzheimer’s disease or mental retardation. The energy drink lawsuit also takes issue with Bang’s claim that it is the healthiest energy drink.
The energy drink lawsuit goes on further to state that the claims regarding super creatine are false because the levels of creatine inside the Bang energy product come in such low amounts that none of the benefits would likely be delivered through safe consumption of the drink.
Monster’s lawsuit has raised concerns about the way that the company is marketing the drink and other safety issues. A current class action lawsuit investigation is looking for consumers who might have purchased Bang energy drink after seeing promotional materials and making their decision based on claims that it could cure a variety of different health conditions.
