A large pharmaceuticals company, Endo Pharmaceuticals, has agreed to pay $775 million in an Endo mesh settlement to end all known mesh lawsuits against them.
Endo Pharmaceuticals PLC began in 1997 when it acquired certain properties from DuPont Merck and has since become a “highly focused generics and specialty branded pharmaceutical company delivering quality medicines through excellence in development, manufacturing and commercialization,” according to their website.
However, over the past several years, over 22,000 lawsuits have been filed against them specifically in the area of vaginal or pelvic mesh complications. Because of this, it has agreed in to resolve all of those claims in an Endo mesh settlement of three-quarters of a billion dollars paid out until 2019.
Vaginal mesh is a screen-like medical device that is implanted into women with pelvic organ prolapse or urinary incontinence. It is used to strengthen and give support to the muscular walls that are needed to repair these conditions.
However, thousands of female patients who have been implanted with Endo vaginal mesh products have complained of tearing, organ damage, tissue infection, mesh erosion, device failure, debilitating pain and organ prolapse.
The proposed Endo mesh settlement would not only settle domestic lawsuits, but international claims as well.
Recently, when Endo announced its proposed Endo mesh settlement, the company said that it would resolve claims at “reasonable values” and will begin making installment payments at the end of 2017. These payments would continue until 2019, according to Law360.
Endo also said that it isn’t aware of any claims against them that would not be covered by the $775 million. Even so, Endo cannot predict future claims or the outcome of any unresolved claims.
In a statement, the CEO of Endo, Paul Campanelli said, “We believe it is a very important milestone for Endo to have reached agreements to resolve virtuallyall known U.S. mesh product liability claims. While it remains possible that additional claims will be filed, we believe today’s announcement will assist most mesh claimants to move forward with their lives and will permit Endo to move forward with an even greater focus on executing against our core strategic priorities.”
Endo Pharmaceuticals spans dozens of subsidiaries including its Astora Women’s Health unit. In March 2016, it began to close this subsidiary because it had been hit with such a high number of product liability lawsuits regarding vaginal mesh. Endo did this, according to Law360, in order to reduce the number of potential lawsuits in the future.
Three years ago, in 2014, a different Endo mesh settlement agreement was reached regarding an Endo subsidiary, American Medical Systems. It was reached to resolve vaginal mesh complications claims, but Endo did not admit any fault in the matters.
Additionally, in 2013, Endo agreed to pay $830 million in an Endo mesh settlement to resolve most of the then-pending vaginal mesh claims against American Medical Systems.
