PACER Excessive Fees LawsuitPatients who have been implanted with the DePuy ASR implant, which was the subject of a voluntary recall in August 2010, may be eligible to receive legal compensation from a DePuy hip implant failure settlement.

Individuals who decide to go through with a hip replacement anticipate that there will be pain and swelling, and that it will take some time for rehabilitation in order to have more normal functioning restored. However, a number of patients continued to have pain, inflammation and other issues long after they should have been on the road to recovery from the surgery.

The DePuy hip implant failure settlement was designed to compensate patients who experienced pain and suffering and who needed revision surgery after their initial hip implant failed.

The DePuy hip implant failure settlement potentially impacts 37,000 individuals who had the hip replacement surgically implanted prior to the recall.

Issues Leading to the Recall Hip Implant Failure  Settlement

The DePuy ASR hip has a metal-on-metal design. These types of implants were designed to be more durable than those made from other materials. However, these metal-on-metal implants have been riddled with complications related to the design and manufacture of the device.

This particular implant has been designed so that the metal pieces touch as they move together when they allow the implant recipient to move. This touching of the metal parts causes friction between the pieces, and small particles of metal can flake off and lodge in nearby tissues and in the bloodstream.

With these particles entering the body tissues in the bloodstream, the body mounts an inflammatory response to the chromium and cobalt metals. This response can cause tissue inflammation and the tissue may also may also suffer from necrosis. When the tissue surrounding the implant dies, the hip implant may become loose and can cause major problems for the implant recipient.

The metal particles the travel in the bloodstream can cause body-wide problems. Systemic endocrine disruption as well as organ damage can be caused from the high levels of metals in the blood, a condition referred to as metallosis.

Other complications resulting from the DePuy ASR metal hip implant may include degenerative heart disease, cancer, bone fractures, pseudotumors, dislocation of the hip, hip implant failure and more.
