eBay has been hit with a class action lawsuit from sellers who claim the online auctioner improperly charged them recurring fees when they signed up for the purported flat-rate “Good Til Cancelled” option.
According to the eBay class action lawsuit, the company first introduced a 30-day auction and, at the same time, a “Good Til Cancelled” option in September 2008. Before the “Good Til Cancelled” option was introduced, eBay charged various fees for things like placing auction listings, adding optional services, and when the item sold. The “Good Til Cancelled” option was introduced by eBay at “no extra cost” and was intended to offer sellers a fixed flat-rate that could be renewed monthly for an indefinite period, the class action lawsuit says.
Despite promoting the “Good Til Cancelled” option as such, the class action lawsuit claims eBay repeatedly charged “Good Til Cancelled” sellers all the fees each time they renewed their listings. At most, they claim, should have been charged a new listing fee with each renewal and should not have been re-charged for the optional services.
According to the eBay “Good Til Cancelled” class action lawsuit, the unannounced change was buried in a section of the company’s eBay Motors’ website titled “The Fine Print,” and wasn’t even located in the main section of the website where most sellers used the option.
The eBay “Good Til Cancelled” Class Action Lawsuit is seeking class certification of eBay sellers who were charged for using the free option, damages, court costs, attorney fees and more. It is also asking that eBay clarify its “no extra charge” language.
The case is Richard Noll v. eBay, Inc., et al., Case No. 11-cv-04585-PSG, U.S. District Court, Northern District of California, San Jose Division.
