Bayer HealthCare is facing a multi-plaintiff Essure side effects lawsuit filed by over two dozen women and their loved ones alleging the female sterilization contraceptive caused them serious injury. These women and their loved ones opted to file the Essure side effects lawsuit together after allegedly suffering similar injuries from the birth control.
The Essure side effects lawsuit claims Bayer HealthCare deliberately downplayed the severity of potential Essure complications, while exaggerating the product’s benefits. Each of the women had opted for the Essure birth control device, after reviewing Bayer’s marketing materials with their doctors.
Overview of Essure Side Effects Lawsuit
Each of these women experienced a number of serious Essure side effects, including migration, abdominal pain, pelvic pain, bloating, weight gain, heavy menstrual flow or irregular bleeding, and even perforated organs. Most of these women had to undergo a hysterectomy to resolve these injuries, which permanently compromised their reproductive systems.
There are over 25 women involved in the Essure side effects lawsuit including but not limited to:
- Illinois plaintiff Christy R., who had the Essure birth control product implanted, and later needed treatment.
- New Jersey plaintiff Jennifer F., who had the Essure birth control product implanted, and later needed treatment.
- Pennsylvania plaintiff Kelly S. had the Essure birth control product implanted, and later needed the device removed.
- Indiana plaintiff Nicole M. had the Essure birth control product implanted, and later needed revision surgery.
- California plaintiff Marilyn T. had the Essure birth control product implanted, and later needed to have the device removed.
The Essure birth control device consists of two metal coils, which are directly implanted into each of the woman’s fallopian tubes. The tissue eventually swells around the coils, and ultimately prevents sperm to egg fertilization.
The Essure birth control device is the only non surgical option for female sterilization, which made it popular soon after its release. The device was even granted accelerated approval from the FDA due to being a minimally invasive alternative to tubal ligation, and entered the market in 2002.
However a number of patients have reported serious side effects due to the coils migrating out of place or experiencing unexpected allergic reactions due to the nickel in the device. Consumer advocates complain the device was not thoroughly investigated before being released to the public, which prevented an an accurate safety profile.
Since the device’s approval, there have been over 4,500 Essure injury reports submitted from women. Each of the women in the Essure side effects lawsuit had used the Essure birth control device for its intended purpose, and did not deviate from prescription instruction or physician advice.
Even with this diligence, these women still experienced side effects and alleged Bayer HealthCare knew the risks but failed to warn the public against them. These women further claim they would not have opted for the Essure birth control device if they had known the potential side effects.
This Essure Side Effects Lawsuit is Case No. 3:17-cv-00758-SMY-SCW, in the Third Judicial Circuit Court of Madison County, Illinois.
In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
