  • Who: Plaintiff Breanna Post filed a class action lawsuit against Dooney & Bourke Inc.

A new class action lawsuit accuses Dooney & Bourke of sending marketing emails to consumers that contained false and misleading information in the subject lines.

Plaintiff Breanna Post claims Dooney & Bourke sent Washington consumers marketing emails with subject lines that employ “various tactics” to create a false sense of urgency and waste consumers’ time.

Post wants to represent a class of Washington residents who received at least one allegedly misleading email from Dooney & Bourke.

Post argues Dooney & Bourke is guilty of violating Washington’s Commercial Electronic Mail Act (CEMA) and Consumer Protection Act.

“Defendant floods consumers’ email inboxes with repeated false notifications that the time to act — i.e. purchase — is short,” the Dooney & Bourke class action lawsuit alleges.

Dooney & Bourke class action: company sent thousands of misleading emails

Post argues Dooney & Bourke sent thousands of allegedly misleading emails to the proposed class during a four-year period.

The plaintiff claims Dooney & Bourke is responsible for sending out emails containing false or misleading statements and that the company regularly uses “false time scarcity claims” to entice consumers to purchase products.

She demands a jury trial and requests declaratory and injunctive relief and an award of statutory damages, treble damages, and attorneys’ fees and costs.

Similarly, a consumer recently sued Crocs, alleging the company sent false and deceptive unsolicited commercial emails in violation of Washington’s CEMA and Consumer Protection Act.
