A new class action lawsuit alleges Dollar General overcharges customers at its Florida stores by advertising lower prices on its shelves than it charges at the register.
Plaintiff Jon C. Capps filed the class action complaint against Dollar General on June 18 in Florida federal court, alleging violations of state consumer laws.
Capps claims Dollar General advertises discounted or lower prices on its shelves to lure customers but then overcharges them at the point of sale in violation of the Florida Deceptive and Unfair Trade Practices Act.
“While Dollar General advertises lower prices and discounted items, customers are routinely charged a higher dollar amount at the cash register than the lower price advertised on the shelf,” the lawsuit alleges.
Capps claims Dollar General has a pattern of overcharging customers in Florida and across the country. The lawsuit cites a similar Dollar General class action lawsuit filed in New York in January 2023 as well as lawsuits filed in Missouri, New Jersey and Ohio.
Dollar General allegedly profits from unsuspecting customers
Capps claims Dollar General profits from unsuspecting customers who rely on the advertised prices.
The plaintiff explains he was overcharged for two 2-liter bottles of Coke Zero at a Dollar General store in Havana, Florida, in March 2024. The bottles were advertised as “2 for $5” but rang up for $6, minus a $0.50 discount, resulting in a total price of two for $5.50, Capps claims.
“Many of its stores are situated in low-income, rural neighborhoods where consumers depend upon Dollar General for their everyday staples,” the Dollar General class action states.
Capps wants to represent a consumer class of Florida residents who paid more for merchandise than the advertised price label on the Dollar General store shelf in the past four years. He is suing for violations of Florida consumer laws and unjust enrichment and is seeking certification of the Dollar General Florida class action, damages, fees, costs and a jury trial.
This Dollar General class action lawsuit is just the latest in several such cases over the years, including one in Oklahoma in 2023.
