Disney class action lawsuit overview:

  • Who: Plaintiff Jeremy Scott filed a class action lawsuit against Disney Platform Distribution Inc.
  • Why: Scott claims Disney failed to cancel his subscription after he requested the company do so.
  • Where: The Disney class action lawsuit was filed in California federal court.

A new class action lawsuit accuses Disney Platform Distribution Inc. of failing to cancel consumers’ subscriptions after they requested the company do so.

Plaintiff Jeremy Scott claims Disney violated the Electronic Funds Transfer Act (EFTA) and California’s Automatic Purchase Renewal Statute (CAPRS) by continuing to charge consumers after they canceled their subscriptions.

Scott wants to represent a nationwide class of consumers who had their bank accounts debited on a recurring basis by Disney without the company obtaining a written authorization signed or similarly authenticated for preauthorized electronic fund transfers within the one year prior to the filing of the complaint.

The plaintiff also wants to represent a class of California consumers who were charged on a recurring basis by Disney without the company providing clear and conspicuous notice of the recurring charges, including information on how to cancel the services within the four years prior to the filing of the complaint.

Scott claims Disney knew about the alleged issue but failed to fix it.

Disney charged plaintiff after subscription cancellation, class action says

Scott claims he signed up for a recurring subscription with Disney through the company’s website in or around 2022.

He argues he canceled his membership with Disney in or around May 2023. However, he claims the company continued to charge his debit card each month until around November 2023.

Scott claims Disney ultimately violated the EFTA and CAPRS as well as California’s Unfair Competition Law.

Scott demands a jury trial and requests declaratory and injunctive relief and an award of statutory and actual damages for himself and all class members.

In February, The Walt Disney Co. faced a class action lawsuit alleging it violated federal and state antitrust laws by suppressing competition in the market for streaming live pay television.

    Yes I too had this experience when I bundled with espn + & Disney. I had a black Friday deal. That they renewed my account at more the. Twice the price i originally paid

    Ive been paying $60 a month on a canceled subscription sometimes 3-4 times a month. It’s been causing me overdraft fees yet I spent have access to the app occasionally and still has ads. I pay more to Disney than my light bill some months. I want to join the lawsuit as I have proof of harm
