Dish Network Robocall Class Action Lawsuit

Dish NetworkA California woman who claims she received dozens of automated collections calls from Dish Network to her cell phone, even though she’s not a Dish Network customer, has filed a class action lawsuit against the company.

Plaintiff Nancy Iniguez says she received daily “robocalls” from Dish Network for a period of two-and-a-half months this summer, which were apparently intended for someone else who failed to return equipment to the company.

Iniguez claims in the Dish Network class action lawsuit that she contacted the company five times to tell them they made a mistake because she never had Dish Network, and this was clearly not her account. Live operators repeatedly assured her the calls would stop, but they continued for months.

Iniguez filed the Dish Network robocall class action lawsuit on September 12, 2012 in Sacramento federal court, alleging multiple violations of the Telephone Consumer Protection Act (TCPA), which forbids companies from placing unsolicited calls to consumers without their prior express permission, and from making these calls through an automated, or autodial, device.

Victims of these companies can get up to $1,000 per TCPA violation, in addition to their attorney’s fees paid. The Dish Network class action lawsuit is seeking $500 for each negligent robocall placed to Class Members, plus $1,500 for each call that came after Iniguez noticed the company of the error.

An attorney from the law firm representing Iniguez said, “There’s a good chance if it’s happening to Mrs. Iniguez, it’s happening to other Americans.”

    When is Dish gone pa
    Appeals ran out over a year ago seriously!

    Dish is so wrong one year o called Comcast (aka) Xfinity

    Dish answered that how crooked dish is

    The lady asked me for my address

    I said you have it tell me

    Dish some how had Comcast customers rerouting the calls to dish

    On a Comcast number

    When I say dish is dirty and that’s an understatement

    Dish doesn’t know when to stop

    I reported it to Comcast (aka) Xfinity cable company

    They were mad

    So! Dish is horrible! In every department
