A California woman has filed a new Unum bad faith insurance claim lawsuit against the disability coverage giant for allegedly improperly denying her long term insurance benefits.
Before she filed for disability benefits, Plaintiff Patricia W. was fully employed and was told she would receive long term disability coverage if she met the qualifications.
Patricia states she had signed up for and had paid insurance premiums for an insurance policy all the way back in 1999, which would cover long term nursing care coverage.
According to the policy, Patricia would qualify for these benefits if suffered an illness or injury that would result in her inability to perform two or more daily activities.
Some of these activities include control of bladder function, inability to conduct personal hygiene, and changing clothes.
According to the Unum bad faith insurance claim lawsuit, Patricia’s disabilities stemmed from complications relating to multiple hip replacement surgeries performed in the short time span between July 2010 to April 2013.
By the time the fourth surgery was performed in April 2013, Patricia had been initially granted long term disability benefits. However, the disability benefits suddenly stopped on Sept. 19, 2013.
Unum Bad Faith Insurance Claim Allegations
Patricia filed an appeal to the insurance company in December 2013, which caused the benefits to be reinstated.
During this time, Patricia had been undergoing physical therapy to recover from her surgeries and was working with different treatments for her incontinence.
It is important to note that during her initial filing and her appeal, Patricia claims she had submitted all necessary medical testimony from her physician.
Furthermore, Patricia said she had followed all administrative procedure when filing for long term disability benefits.
According to the Unum bad faith insurance claim lawsuit, Patricia has been eligible for long term disability benefits since she first filed several years prior.
Not only was Patricia qualified based on her disabilities, she also has lost a significant percentage of her income due to her inability to work.
Patricia’s Unum bad faith insurance claim lawsuit states that even though she was qualified and entitled to these long term benefits, the insurance company continues to deny the benefits. In addition, Patricia had been paying insurance premiums to insure that she would receive adequate care in the case of devastating disabilities.
Unum had most recently denied her disability benefits in April 2015, which has exhausted all of Patricia’s administrative options.
Patricia is filing this Unum bad faith insurance claim lawsuit alleging the insurance company denied her benefits for insufficient or unethical reasons. She is seeking all missed monthly payments, plus any additional interests.
