If you have endured hip revision surgery due to a metal-on-metal hip implant problem, you could qualify for a portion of the DePuy ASR hip settlement.
Attorneys familiar with this litigation estimate that patients who have undergone hip revision surgery since March 2015 may receive between $200,000 and $500,000 each.
Johnson & Johnson’s DePuy ASR XL Acetabular System is a metal-on-metal hip implant system that has sparked thousands of lawsuits. Johnson & Johnson announced a DePuy ASR hip recall in August 2010 because of a proliferation of reports of serious, debilitating complications.
More than 93,000 DePuy ASR hip implants worldwide are affected by the recall, and 37,000 of those are in the U.S.
The DePuy ASR hip settlement addresses several complications suffered by implant recipients, including an increased risk of cancer due to toxic substances leaching out of the metal parts.
Because differing metallic alloys rub against one another during movement, tiny metal pieces shred from the hip implant parts. These metal fragments cause irritation and swelling as the body reacts to the particles as foreign bodies. The lymphatic system sends fluid to the area in an effort to flush out the foreign matter. This fluid can create pseudotumors that surround the implant, causing pain and swelling.
The metals also can leach toxic ions into the blood, increasing the risk of cancer while also causing metal poisoning.
Metals also can cause dilated cardiomyopathy, causing the heart muscle to become enlarged. The enlarged heart can’t effectively pump blood, leading to lethargy, swollen legs, shortness of breath, an irregular heartbeat or heart failure.
In addition to the above complications, the DePuy ASR hip implant can prematurely fail, requiring relatively early revision surgery.
