Bank of America UPDATE: Refund checks from the Bank of America Overdraft Class Action Lawsuit Settlement are in the mail!

Top Class Actions reported in June that Bank of America (NASDAQ: BAC) had reached a $410 million class action lawsuit settlement for charging excessive overdraft fees. We’ve just learned that some Bank of America customers have started receiving notices in the mail concerning how to receive a payment or account credit from the class action settlement.

The Bank of America overdraft fee settlement will resolve a class action lawsuit, entitled In re: Checking Account Overdraft Litigation, that accuses Bank of America and nearly 30 other banks of manipulating debit transactions to maximize the fees they could charge customers who overdrew their bank accounts. Bank of America denies any wrongdoing, but has agreed to settle its part in the case by creating a $410 million settlement fund to reimburse Class Members.

You’re considered a Class Member of the Bank of America overdraft fee class action settlement if you had a Bank of America checking account and/or savings account that you could access with a BofA debit card, anytime between January 1, 2001 and May 24, 2011, and you were charged one or more overdraft fees as a result of Bank of America’s practice of posting debit card transactions from highest to lowest dollar amount.

As part of the Bank of America overdraft settlement, Class Members will receive payments or account credits for the unlawful overdraft fees they paid. The amount of such payments or account credits cannot be determined at this time, but will be based on the number of people in the Settlement Class and the amount of additional overdraft fees each Settlement Class Member paid as a result of Bank of America’s posting order.

If you are included in the Settlement Class and entitled to receive a cash benefit, you do not need to do anything to receive a payment or account credit from the BofA overdraft settlement. If you Court approves the Settlement and it becomes final and effective, you will automatically receive a payment or account credit.

However, if you wish to opt-out of the Bank of America settlement and retain your right to sue individually, you have until October 3, 2011 to submit your request for exclusion.

    hi well got a post card style looking like a check for the settlement of 20.88$ but i dont bank with BofA no more so where di i cash this check… on the check it says US bank so is that where to get my 20.88$ … cause the amount i got is miss a couple of zeros…. for what was taken from my account

    Does anyone know how the money will be divide? Once I wrote a check at walmart for twenty one dollars and only had 19 in the bank wal mart kept putting the check in at a rate of three times a day for 6 month i called bank of America and even paid $45 for a stop check payment it did not stop I was happy because I was going to finally be getting child support $388 a month for 6 month went all to bank of America. I could not stop the child support from going in my account and had to wait until it fixed it self. Wal mart should be sued to all the times they put it in. target does it twice then send you a form asking you to pay it (No I did not write a bad check there. I worked their for three years.)

    the thing with this settlement is a joke, for 1 we have to pay their lawyers, dont thing so, 2 they ripped me off for over 10,000 dollars while i was in Iraq, what happened to all those veterans and military people? are they going to get any money? I think they should start over and get it right, 3 every American in the states that still banks with BofA should go down and CLOSE their accounts and go to another bank and see what happens, maybe someone will open their eyes to this big scam the bank has done which got the the government involved, we vote, ask a rep or senator what they think, the bank is responsible make THEM pay big time!!!!

    I been with this bank for ten years i can pay my bills for the overdrafts fees i can get AV for the overdraft fees I’m making minimum wage i can can pay my bills that’s why i got so many over draft fees can even work on my truck to give it a tune up i need this settlement so i can pay my bills

    I can pay my bills for the overdrafts credit every 35.00 dollars they take out it is less i have to pay my bills I’m falling behind in my bills because i got pay overdraft fees.

A Club if you will, The Idiots Club of Jackasses!!! Thats ALL OF US , THE BANK OF AMERICAS (JACKASSES) BANKING CUSTOMERS(IDIOTS)!!!! I have been to every site listed and ther are NO concrete answers to anything!!!! Oh i might add ,the law firm supposed to be representing US, HA, have ever responded to any of my requests,letters or phone calls!!! I have a sic feeling, its a run around !!! Anyone notice this, CANNOT LOCATE A CLAIM FORM , any where?????? There is alot I could be doing with my time!!! Instead , I choose to beleive these liars, trusting these court appointed ass#*%^(!!!! Anyone with a new idea of what we can do now?
