hip-replacement-xraysA DePuy hip lawsuit was filed by two New York residents after a DePuy hip implant allegedly failed and caused the plaintiffs serious injuries.

The DePuy hip lawsuit claimed that the metal-on-metal hip implant was defective and that the plaintiffs are entitled to compensation for the pain and suffering allegedly caused by the DePuy device.

Plaintiff Helen G. had the DePuy hip implant system inserted on Dec. 4, 2012. She claimed she suffered from painful side effects following the implant surgery. One of the complaints made in the DePuy hip lawsuit was that she felt that the metal-on-metal hip implant could not support her weight.

The DePuy hip lawsuit also claimed that the device caused Helen to suffer from chronic pain. Helen’s husband Robert  G. claimed that the DePuy hip caused him to suffer from loss of consortium. Loss of consortium essentially means loss of intimacy with a spouse.

In November 2014, Helen underwent surgery in order to have the DePuy hip implant removed from her body due to the allegedly painful side effects (including trouble using her hip, fatigue, and tissue inflammation) and the metal poisoning allegedly caused by metal shavings being released into her bloodstream.

The DePuy hip lawsuit is seeking compensation for the injuries allegedly caused by the metal-on-metal hip implant, emotional and physical pain and suffering, lost wages, medial bills, and other additional damages.

DePuy allegedly failed to warn against dangerous and painful side effects of its metal-on-metal hip implant. Additionally, DePuy hip lawsuits have claimed that the devices were designed defectively, which led to early hip implant failure.

Allegations in this DePuy hip lawsuit include negligence, strict product liability, design defect, breach of warranty, loss of consortium, manufacturing design, negligent misrepresentation, and failure to warn.

Metal-on-Metal Hip Implant Failure

Thousands of individuals have filed hip implant lawsuits after their metal-on-metal hip implants allegedly prematurely failed and caused plaintiffs to suffer from extremely painful conditions including revision surgery.

Metal-on-metal hip implant lawsuits have become common and have resulted in big payouts. Johnson & Johnson, for example, paid a $2.5 billion settlement to victims of hip implant failure. Thousands of devices have been recalled across the country.

Side effects of metal-on-metal hip implant failure may include:

  • Failure of the metal on metal hip implant requiring early replacement
  • Dislocated hip
  • Leaking of toxic substances in the bloodstream from the hip implant
  • Cancer
  • Degenerative heart disease or cardiomyopathy
  • Loss of bone strength or structure which can result in bone fractures
  • Tissue death for any tissue surrounding the implant
  • Non-cancerous tumors or pseudotumors around the hip implant
  • Cobalt poisoning
  • Metallosis or metal poisoning due to chromium or cobalt particles from the hip implant leaking into nearby tissue or the patient’s bloodstream
