Johnson & Johnson has faced thousands of lawsuits since the FDA announced the DePuy voluntary recall of their ASR hip implant system in August 2010.

Nearly 37,000 of these implants were implanted in the United States. A study from the United Kingdom found that at least 13 percent of the ASR hip implants will need revision surgery.

DePuy Hip Implant Settlement Due to Metal Device Issues

The DePuy hip implant settlement is available to patients who could have experienced a variety of issues from the metal-on-metal device.

The DePuy implant can release tiny metal shavings into the body, resulting in high cobalt or chromium levels in the blood. Metal poisoning, also known as metallosis, can lead to tissue death for the tissue surrounding the implant.

The metal parts that move against one another during movement have to be surgically removed to stop ongoing metal poisoning.

Side effects from metal-on-metal hip systems can affect more than just the joint and surrounding tissue. Degenerative heart disease, impaired renal function and thyroid dysfunction have all been linked to implant failure.

Other conditions that can qualify you for the DePuy hip implant settlement include hip dislocation, reduced bone strength that has led to a fracture, fluid collection or development of pseudotumors around the implant that cause pain, pressure and inflammation.

You could qualify for the DePuy hip implant settlement if you have suffered from cancer caused by toxic metals entering your system.

Patients who had the DePuy Pinnacle hip replacement system reported the same side effects. Despite the Pinnacle system’s poor track record, DePuy based the ASR system in large part on the Pinnacle’s design.

The FDA warns recipients of metal-on-metal hip implants to watch for the following symptoms of device failure:

  • Pain while moving or walking
  • Swelling in the hip or groin area
  • Lumps near the hip
  • Dislocation, or feeling the joint has slipped out of place
  • Squeaking or popping noises while moving

Johnson & Johnson management allegedly knew the ASR hip implant’s design was defective. During one recent trial, attorneys provided an internal Johnson & Johnson memo indicating that 40 percent of those who underwent ASR hip implant surgery would need revision surgery within only five years.

Johnson & Johnson initially agreed to pay a combined $600,000 in three DePuy hip implant settlements in 2012. Those three patients had hip revision surgeries after their DePuy ASR systems failed. Each of them had experienced pain, bone damage and other adverse complications.

Johnson & Johnson has paid $4 billion to settle thousands of ASR hip replacement lawsuits.

Qualifying patients could receive up to $500,000 each in DePuy hip implant settlement payments.
