A growing number of patients implanted with the DePuy ASR device have had to undergo hip replacement revision surgery, leading some to file lawsuits against DePuy. These hip implant lawsuits allege that the DePuy ASR hip implant caused serious complications, necessitating hip replacement revision surgery. In many cases, these lawsuits have resulted in substantial settlements, some of which amount to hundreds of thousands of dollars.
The DePuy ASR Hip Implant
Every year, thousands of Americans are implanted with hip devices, making hip replacement surgery one of the most common surgical procedures in the country. Indeed, over half a million Americans have been implanted with a hip device. Many of these devices are metal-on-metal, meaning that two metal components are placed directly next to each other. The DePuy ASR device is metal-on-metal, and has been a popular option for patients undergoing hip replacement surgery.
Although DePuy’s ASR hip implant device has become undeniably popular since its approval and release onto the market, patients with these devices have begun coming forward, claiming that they have suffered significant complications because of this device. Thousands of patients have already filed lawsuits against DePuy over complications allegedly linked with is ASR hip implant. Hip implant devices have been linked with problems like metallosis (a kind of metal poisoning), dislocation and dissociation of the device, and a high rate of device failure.
The U.S. Food and Drug Administration (FDA) shares these concerns, and has received countless reports of device failure and other side effects. The FDA announced a recall of the metal-on-metal device in August 2010, affecting around 93,000 total patients with these implants. Around a third of those affected were American patients.
Unfortunately, complications with hip implants are often serious enough to necessitate hip replacement revision surgery in order to remove the defective device and replace it with something else. Of course, a hip replacement revision surgery will expose patients to even more dangers, such as the risk of infection, as well as the increased medical expenses of an extra surgery.
Thousands of Americans have been left with defective devices implanted in their hips, meaning that they are still at risk of complications and the need for hip replacement revision surgery.
Filing a Lawsuit After Hip Replacement Revision Surgery
Those who have suffered injuries or been forced to undergo a hip replacement revision surgery after being implanted with a DePuy device may be able to pursue a DePuy ASR settlement for compensation. Nearly 8,000 DePuy lawsuits have been filed over the hip implant device so far. The first group of such lawsuits reached a DePuy ASR settlement of $600,000. Later settlement agreements secured much more compensation for thousands of affected patients.
If you or someone you love has undergone hip replacement revision surgery due to complications from the DePuy ASR implant, you may qualify for compensation from the DePuy ASR hip implant settlement. Patients eligible for a DePuy ASR settlement include those who have had hip implant surgery since March 2015. Of course, filing a hip replacement revision surgery lawsuit cannot take away the pain and suffering caused by device complications, but it can help to alleviate the financial burden from medical expenses and lost wages.
