DePuy Orthopaedics is facing a pending multidistrict litigation (MDL) from numerous patients alleging serious metal hip implant complications. The company is facing a new DePuy ASR hip implant lawsuit added to the litigation by a Michigan man alleging serious problems with the metal hip implant.
Plaintiff David S. says he opted for the ASR hip implant after receiving the company’s marketing materials, but had eventually developed unexpected problems. David is filing this DePuy ASR hip implant lawsuit against the company, alleging the company failed to warn him against potential metal hip implant complications.
According to the DePuy ASR hip implant lawsuit, David had the DePuy ASR hip implant implemented on his right hip on Feb. 14, 2008. Soon after the DePuy ASR hip was implanted, David says he experienced serious and substantial injuries that had eventually forced David to undergo risky treatment procedures.
Eventually the metal hip implant complications had forced David undergo revision surgery on Nov. 7, 2016, with doctors explanting the metal hip implant. David filed the DePuy ASR hip implant lawsuit against the company, alleging DePuy Orthopaedics had failed to notify him of the dangers their metal hip implant presented.
Overview of Metal Hip Implant Complications
David decided to file the DePuy ASR hip implant lawsuit after discovering the ASR hip implant had been recalled from the market due to similar hip implant complications he had experienced. The complications in question were linked to to metallosis, or blood metal poisoning, due to the metal hip components interacting and shedding metal ions into the bloodstream.
The DePuy ASR hip implant is a metal-on-metal hip implant, consisting of chromium and cobalt components. When the ball and socket joint interacts, metal ions are shed and can potentially result in metallosis.
Along with causing dangerously elevated blood metal levels, metal hip implants are also prone to corrosion, fretting, device failure, tissue death surrounding the implant, and the formation of pseudotumors.
When metal on metal hip implants were first released in the country, they were thought to be overtly superior to plastic or ceramic models. Manufacturing companies advertised them to be more durable and longer lasting than other hip implant options, making them very popular with younger patients.
However it was not long until patients started reporting metal hip implant complications, which have resulted in patients enduring pain and paying expensive medical bills.
Even though these complications can be devastating to patients, DePuy Orthopaedics allegedly failed to disclose this information to the public. Numerous patients have opted to file legal action, resulting in a consolidation of several of these claims into a single multidistrict litigation.
David states that he never would have opted for the DePuy ASR hip implant if he had been aware of the complications associated with the device.
This ASR Hip Implant Lawsuit is Case No. 1:17-dp-20032-JJH in the U.S. District Court for the Northern District of Ohio, Western Division.
