A new class action lawsuit accuses Depop of charging consumers unlawful hidden fees when they make purchases on its website.

Plaintiff Linsey Dinh filed the class action complaint against Depop on Feb. 6 in California federal court, alleging violations of state consumer laws.

According to the class action lawsuit, Depop, a second-hand clothing marketplace, engages in a practice known as “drip pricing,” where the advertised price of an item fails to include a mandatory “marketplace” fee.

This fee is only disclosed at the checkout stage, leaving consumers blindsided and often forcing them to reconsider their purchase, the Depop class action lawsuit alleges.

Dinh claims that when she purchased an item from Depop in January 2025, she was charged an additional $1.55 marketplace fee at checkout, which was not included in the item’s advertised price of $17.00.

The class action lawsuit alleges that this practice is not only misleading but also illegal under California’s Honest Pricing Law, which requires businesses to include all mandatory fees in the advertised price of a product.

Depop’s hidden fees prevent informed decisions, lawsuit alleges

The class action lawsuit claims that Depop’s hidden fees prevent consumers from making informed purchasing decisions and comparing prices with competitors.

“By the time the defendant discloses this fee, consumers have already spent their time carefully reviewing and selecting the clothing items they wish to purchase,” the lawsuit says. “In doing so, users rely on the defendant’s previously advertised prices.”

The lawsuit seeks to represent a nationwide class of consumers who purchased items from Depop and were charged the marketplace fee without prior disclosure.

The plaintiff is suing for violations of California’s Consumers Legal Remedies Act, Unfair Competition Law, False Advertising Law and unjust enrichment and is seeking certification of the Depop class action, damages, restitution, declaratory relief, injunctive relief and fees.

Also in California, a class action lawsuit accuses SeaWorld of using fake sales and hidden fees to trick customers into purchasing overpriced tickets.
