woman files Credit One Bank robocall complaintsA consumer has launched a TPCA class action lawsuit over numerous Credit One Bank robocall complaints. The plaintiff consumer claims that the bank calls people without their consent, and does so via the use of an autodialer, or robocalls.

Plaintiff Eileen Waldron claims that she has never been a customer of Credit One Bank, and has never provided the company with her cellphone number or consent to call. However, she says that despite this, she received numerous bothersome robocalls from Credit One Bank, beginning in December 2014 after she got a new cell phone number.

Waldron argues that Credit One Bank knowingly violated the Telephone Consumer Protection Act, which protects consumers from bothersome robocalls and telemarketing. She states that the TCPA prohibits businesses from contacting individuals without their consent, and from using robocalls and autodialers when making telemarketing calls. Credit One Bank, she believes, knew or should have known this information yet had a widespread policy of making unlawful calls nonetheless.

To provide support for her Credit One Bank robocall complaints that the company made a widespread practice of violating the TCPA, Waldron cites numerous online complaints from customers who say that Credit One contacted them without their consent using robocalls, and did not cease the calls when requested.

TCPA Violations

According to Waldron, she and other consumers who received robocalls from Credit One Bank were injured by the calls as they were bothered by the call frequency; were forced to use their phone, minutes, and data plan to receive the calls; and because they had to use their time and resources to attempt to have Credit One stop contacting them.

Waldron’s Credit One Bank robocalls complaint class action lawsuit says that these calls came from many different numbers and continued over a period of two months. Moreover, she answered many of these calls. Waldron argues that these phone calls were a robocall, which she could tell because there was a “noticeable delay of a few seconds before connecting to a live operator.”

Waldron goes on to say that during the phone calls, a Credit One operator would ask her about her late loans with Credit One, though she has never been a customer with the bank and has no loans with the company. She claims that around 60 calls, she explained this fact to the Credit One operator. She also alleges that multiple times she requested that the company stop calling her, but this had no effect.

Waldron claims that she only stopped receiving calls from Credit One after she changed her telephone number specifically to prevent Credit One from calling her again.

The Credit One bank robocalls complaints lawsuit says that Waldron sought “an explanation of why they were calling [her] hundreds of times” and asked for a “refund of minutes they used up on [her] phone.” The company allegedly told her that her number had been provided as a contact number for one of the company’s cardholders, and that they would remove her number from the records. However, the company reportedly denied her request for a refund for minutes they used up when calling her.

    How do I go about adding my name to this law suit, Credit one bank has robo called me 5 times today alone e from various numbers from different states. They never leave a voicemail but when I call back it states they are credit one.

      They closed both accounts and lock you from make a payment for no reason at all and charge all the fee you think of please shut this bank down and I have not to do with them and I am file report with,the bank commit or the general lawyer look in to

    How do I go about adding myself to this? I’ve had nothing but issues with credit one and multiple phone calls! I’ve spent hours on the phone with them after I paid then there”fees” and I’m still continuing to get statements and letters with a negative balance after I closed my account and paid them and spoken to multiple supervisors.
