Southern New Hampshire University (SNHU) will pay $1.25 million to settle a class action lawsuit filed by a student seeking a tuition refund, claiming she didn’t receive the on-campus learning experience she paid for during the spring 2020 semester because of the coronavirus pandemic.
The Class is made up of all students and former students who paid, or on whose behalf payment was made to SNHU for spring 2020 semester tuition and fees for in-person educational services, and whose tuition and fees have not been refunded.
A class action lawsuit had claimed Southern New Hampshire University breached its contract with students to provide in-person education during the spring semester of 2020 by transitioning to remote learning due to the COVID-19 pandemic; the school allegedly did not provide a partial fee tuition refund.
SNHU maintains it has not violated any laws, but has agreed to the settlement in order to avoid the risk and expense of ongoing litigation.
The university in Manchester, New Hampshire, has more than 3,000 on-campus students and more than 135,000 online students, according to the SNHU website.
Anyone who qualifies for a payment will receive a pro rata share of the settlement fund. This share will be based on the total out-of-pocket tuition and fees the Class Member paid for the spring 2020 semester.
Class Members do not need to take any action in order to benefit from the SNHU tuition refund settlement.
However, Class Members who wish to receive their payment via PayPal or Venmo, rather than by check, must submit a completed election form.
A final hearing on the SNHU tuition refund settlement will be held July 29, 2021.
The deadline for individuals to opt out of the settlement has passed.
Those who would like to object must do so by July 15, 2021.
Election forms must be submitted by July 29, 2021.
