Couple Files Onglyza Lawsuit After Suffering Congestive Heart FailurePlaintiffs Tommy L. and Christy S. filed an Onglyza lawsuit in Oklahoma federal court due to adverse side effects and injuries. The Onglyza lawsuit was filed on March 28, 2018.

According to the Onglyza lawsuit, both plaintiffs are residents and citizens of the state of Oklahoma. On April 9, 2015 Tommy alleges he began treatment for congestive heart failure. According to the Onglyza lawsuit, Tommy experienced “significant shortness of breath, fatigue, chronic coughing, edema, nausea, lack of appetite, confusion, and high heart rate” after starting the medication.

Further, Tommy failed to recognizing the symptoms of congestive heart failure allegedly caused by his use of Onglyza. When he exercised, he says experienced intermittent difficulty breathing. As a result, he says his medications were modified but he was also given a cardiac referral.

Tommy says he is currently being treated for his development of congestive heart failure. In addition to significant bodily injuries, Tommy alleges he is suffering from mental anguish, embarrassment, disfigurement, pain and suffering, mental injuries, loss of earnings and earning capacity, inconvenience, and has incurred past and future medical expenses.

According to the Onglyza lawsuit, had Tommy’s prescribing physicians known about the adverse side effects and complications linked to Onglyza, they would have never prescribed the medication to him in the first place.

Tommy’s “prescribing health care providers were unaware of the true degree, incidence, and risk of heart failure, congestive heart failure, cardiac failure, and death related to those events associated with the use of Saxagliptin, and if they had been informed, would have used and prescribed alternative therapies …” the Onglyza lawsuit states.

Tommy demands a trial by jury.

The Onglyza lawsuit was filed on multiple counts including design defect, negligence, negligence per se, violation of the Oklahoma Unfair and Deceptive Trade Practices Act, failure to warn, breach of warranty of merchantability, breach of express warranty, breach of implied warranty, fraudulent misrepresentation, negligent misrepresentation, fraudulent concealment, fraud, loss of consortium, request for punitive damages.

Overview: Onglyza Lawsuit

Onglyza first became approved by the U.S. Food and Drug Administration (FDA) in 2009. It is a type-2 diabetes medication that helps control patient’s blood sugar levels. Onglyza’s active ingredient, however, is saxagliptin; a DPP-4 inhibitor. As an enzyme, it breaks down GLP-1, a hormone that becomes released into the bloodstream after food absorption. What GLP-1 does is signal insulin to be released from the pancreas. Onglyza essentially stops DPP-1 from breaking down GLP-1 which allows the pancreas to create and release insulin.

However, several severe and adverse side effects have been linked to Onglyza. These side effects have all included heart failure, inflammation of the pancreas, low blood sugar, joint pain, allergic reaction, skin reaction, and allergic retention. Other complications associated with Onglyza have also include vomiting, cough, headache, sore throat, runny nose, urinary tract infections, diarrhea, upper respiratory tract infection, stomach pain, and low blood sugar.

An FDA advisory committee recently urged Onglyza’s manufacturers to include a warning label advising of Onglyza’s link to causing congestive heart failure.

The Onglyza Lawsuit is Case No. 5:18-cv-00374-KKC, in the U.S. District Court for the Eastern District of Oklahoma.
