A North Carolina couple recently filed a lawsuit against DePuy Orthopaedics Inc., alleging that implantation with the company’s DePuy ASR hip implant led to severe complications for one plaintiff.
The injured plaintiff, Carol W., says she was implanted with a DePuy hip implant in her left hip in August 2008. According to her DePuy lawsuit, Carol began suffering from pain and discomfort in her hip afterwards – symptoms she says were a direct result of the surgery.
After experiencing pain and discomfort for years, she eventually had the implant explanted in August 2016.
Although the plaintiff suffered pain and discomfort for years following her initial surgery, she did not become aware of a connection between her injuries and the DePuy ASR hip implant she received until after DePuy issued a recall for the device.
Her hip implant lawsuit claims damages for injury, economic loss, loss of services, and loss of consortium on behalf of the plaintiff and her spouse.
The claim was filed on multiple counts, including negligence, defective design, manufacturing defect, failure to warn, breach of express and implied warranties, fraudulent misrepresentation and concealment, and several others.
Carol’s DePuy Hip Implant Lawsuit is Case No. 1:17-dp-20011-JJH, in the U.S. District Court for the Northern District of Ohio, Western Division.
Metal-on-Metal Hip Replacement Problems
Complications of hip replacement can be fairly serious. These devices, including the DePuy ASR hip implant, may be associated with a higher-than-expected failure rate.
They can also release highly toxic metal ions into a patient’s tissue and bloodstream. Particles released from the metal-on-metal hip implant devices can also cause metallosis, tissue death, and tumor growth.
Components of the DePuy ASR hip implant were recalled in August 2010.
DePuy ASR Hip Implant Lawsuits
Metal hip implant lawsuits allege that DePuy had material knowledge that its metal-on-metal hip replacement systems were defective and therefore not safe prior to selling the product.
Plaintiffs allege the company failed to adequately warn the public and the medical community about their device’s risks and even actively concealed its defects. They claim that had they known about these risks, they could have chosen a safer implant.
If you or someone you love was implanted with a DePuy hip implant and have suffered from these or other side effects, you may be able to file a DePuy hip implant lawsuit.
Filing a claim can result in financial compensation that can help with medical expenses and other financial losses felt as a result of these injuries. Spouses of injured patients may also be able to file a claim for loss of consortium.
