Vikings fire sprinklers - viking settlement - VK457

A Viking fire sprinklers class action lawsuit will end in a settlement resolving claims that Viking’s model VK457 sprinklers can activate without a fire.

The Viking class action lawsuit settlement benefits individuals who owned or occupied a property that contained Viking fire sprinklers between Jan. 1, 2013, and March 31, 2015, and/or who either paid to replace those sprinklers or paid for damages resulting from a non-fire activation. The settlement website includes instructions for determining the model of a Viking fire sprinkler.

Plaintiff Gayl Jackson filed the Viking fire sprinklers class action in July 2018, claiming the sprinklers were defective and prone to activating despite there being no fire. These activations allegedly caused property damage when buildings were needlessly doused with water.

Since the Viking VK457 fire sprinklers class action lawsuit was filed, both sides of the complaint have reportedly reviewed over 79,500 pages of relevant documents and spent significant time and effort litigating the issue.

Viking Group Inc. has not admitted any wrongdoing but has agreed to resolve the claims against them in a settlement. A website was established for the settlement in January.

The settlement website notes the deal was reached through an in-person mediation session overseen by a retired judge. The extensive process allegedly took course over many months but eventually resulted in a favorable conclusion.

Under the settlement, consumers can choose to have their sprinklers replaced at no cost with a similar model of equal or greater quality. If Class Members have already paid out-of-pocket to have the sprinklers replaced, they can collect up to $35 in reimbursements per sprinkler replaced. Individuals who had a proven non-fire activation of their sprinklers can collect up to 70 percent reimbursement of property damage.

The deadline for exclusion and objection to the Viking class action lawsuit settlement was May 8, 2020.

The final approval hearing for the Viking VK457 fire sprinklers class action settlement was held June 18, 2020.

In order to receive replacement benefits, Class Members need to file a valid claim form by Feb. 28, 2022. In order to receive activation benefits, Class Members must file a valid claim by Aug. 28, 2022. Activation claim forms became available May 9, 2020.

Who’s Eligible

Individuals who owned or occupied a property which contained certain Viking fire sprinklers (model VK457) between Jan. 1, 2013, and March 31, 2015, and/or who either paid to replace those sprinklers or paid for damages resulting from a non-fire activation.

Potential Award

Replacement of Viking fire sprinklers or reimbursement for out-of-pocket replacement costs. Up to $35 in reimbursement will be provided for each sprinkler replaced.

In the case of a non-fire activation occurring after May 9, 2020, consumers can collect up to 70 percent of property damage expenses. Non-fire activations occurring before May 9, 2020 are not eligible for this benefit.

Proof of Purchase

For Replacement Claims, claims must include supporting documentation that proves a consumer paid to replace the sprinklers.

For Activation Claims, consumers must provide proof that a qualifying non-fire activation occurred. This includes installer or contractor records, photographs, videos, invoices, receipts, credit card statements, inspection records, insurance records, or other proof.
