A Connecticut woman has filed a Lipitor lawsuit against Pfizer Inc., alleging she developed injuries including type-2 diabetes after using the popular cholesterol medication.
According to the Lipitor type-2 diabetes lawsuit, 80-year old plaintiff Anna A. took the Pfizer drug from 2001 to 2012, presumably to manage a high cholesterol condition. However, in August 2011, Anna was diagnosed with type-2 diabetes, a condition she claims was caused by her use of Lipitor.
Anna alleges that because of Pfizer actions or inactions, “she suffered grievous bodily injury and consequently economic and other losses, including but not limited to pain and suffering, emotional distress and loss of enjoyment of life,” according to the Lipitor lawsuit.
The plaintiff brings several allegations against the drug manufacturer, including claims of negligence, negligent misrepresentation, negligent design, design defect, failure to warn, breach of express warranty, breach of implied warranties, fraud and misrepresentation, constructive fraud, unjust enrichment, and punitive damages.
Anna has request that this Lipitor lawsuit go to trial by jury. It has been consolidated as part of the national multidistrict litigation or Lipitor MDL, wherein hundreds of women have filed similar claims against Pfizer.
The Lipitor Lawsuit is Case No. 2:15-cv-02854-RMG, and is part of the Lipitor MDL known as In Re: Lipitor (Atorvastatin Calcium) Marketing, Sales Practices and Products Liability Litigation, MDL No. 2:14-mn-02502-RMG, in the U.S. District Court for the District of South Carolina, Charleston Division.
Type-2 Diabetes and Lipitor Users
According to recent lawsuits, more than 4,000 women consumers who were prescribed the blockbuster cholesterol medication manufactured by Pfizer reported developing type-2 diabetes as a Lipitor side effect. As a result, there has been a wave of lawsuits filed against Pfizer, with plaintiffs seeking compensation for Lipitor type-2 diabetes side effects, injuries, and complications. The majority of these lawsuits have been consolidated in the Lipitor MDL in South Carolina court.
Additionally, the FDA issued an August 2011 notice that required Pfizer, Inc. to include new type-2 diabetes risk warnings on Lipitor’s marketing and labeling. The federal agency followed this Pfizer-specific mandate with a general drug label mandate to all statin drug manufacturers, requiring them to include a type-2 diabetes side effects warning.
Pfizer finally complied with the FDA mandate in February 2012, which potentially informed many consumers and doctors of Lipitor diabetes risks, allowing them to make an informed decision whether or not to prescribe and take the medication.
However, this label change does not reverse or repair the Lipitor side effects many women consumers have developed prior to the 2012 label update. As a result, many women are pursuing litigation against Pfizer, hoping to gain compensation for their various Lipitor type-2 diabetes injuries.
