A new nationwide class action lawsuit alleges clothing company Comfrt uses fake sales prices for discounted products, misleading consumers into thinking they are getting a good deal.
Plaintiff Anna Fischer filed the class action lawsuit against Comfrt LLC on Feb. 24 in California federal court.
According to the complaint, the company advertises fictitious prices and corresponding phantom discounts on “nearly every product” on the Comfrt website. This price disparity “misleads consumers into believing they are receiving a good deal, thereby inducing them to make a purchase,” the class action alleges.
Fischer says this practice of false reference pricing occurs when a retailer fabricates a fake regular, original and/or former reference price to advertise a deeply “discounted” price.
Comfrt never sells products at their ‘original’ price, lawsuit alleges
Fischer argues that the advertised discounts are deceptive because according to federal regulations, a reference price should represent a bona fide price at which goods were previously sold in a substantial quantity and for a reasonable period of time.
In addition, the reference price should be the prevailing market retail price within three months immediately preceding the advertised former reference price, as required by California law, she argues.
The lawsuit seeks to represent anyone in the United States who purchased one or more of Comfrt’s products from Comfrt’s website between Jan. 1, 2022, through the present at a discount from a higher reference price and who have not received a refund or credit for their purchases.
It seeks damages, injunctive relief, fees, costs and a jury trial.
Recently, similar class actions for false reference pricing have been filed against Lowe’s Home Centers, L.L. Bean, Under Armour and Sleep Number.
