Comcast-Class-ActionAlready on the receiving end of negative customer reviews, Comcast is now facing a $100 million lawsuit from the state of Washington over their allegedly misleading Comcast protection plan.

The state of Washington has filed this massive lawsuit against Comcast regarding the company’s service plan, citing nearly two million violations of Washington’s Consumer Protection Act.

Comcast has denied any wrongdoing. However, Washington claims that the plan called the “Service Protection Plan” is misleading and does not actually cover what it says it covers.

The Washington Attorney General, Bob Ferguson, accuses Comcast of illegally deceiving their customers in order to increase their bottom line by millions of dollars.

According to the Comcast protection plan lawsuit, the company misrepresented the scope of their Service Protection Plan, stating that it covered things it actually did not.

The state of Washington seeks refunds for over 400,000 state residents.

Comcast Protection Plan Details

The Comcast Service Protection Plan costs customers $4.99 per month. The plan was marketed as being “comprehensive” and one that includes service on “inside wiring.” Comcast also claimed that the monthly fee covered all service calls as well as service on customer owned equipment connected to Comcast equipment.

However, the plan did not actually include wiring that is within a wall, or “wall-fished” wiring, even though customers believed it did.

The Attorney General’s office investigated this and heard from many customers who made phone calls to Comcast, to discover what the company told customers.

Seventy-five percent of the time, Comcast service representatives told the customers that the plan covered all inside wiring, according to the Attorney General’s office.

Investigators also discovered that Comcast misleads its customers about other parts of its plan, including the coverage of service calls regarding customer owned equipment as well as the repair of cable jumpers, connectors and splitters.

The company allegedly says it does not provide coverage for repairs to customer equipment such as TVs, DVD players or surround sound.

Comcast asserts that these details are in the Comcast protection plan terms of service. However, the company does not actively provide this to customers, according to the Attorney General’s office. Customers must intentionally search Comcast’s website to find this information.

In essence, this renders parts of the Service Protection Plan useless, and the revenue Comcast has been collecting from customers each month is illegal, according to the Attorney General’s office.

According to the details spelled out on the Comcast website, the Service Protection Plan covers the following:

  • Unlimited covered service calls with no contracts.
  • Troubleshooting and diagnosis of XFINITY TV, XFINITY Voice, XFINITY Internet and XFINITY Home service problems.
  • Hassle-free replacement and repair of defective customer inside wiring.
  • Hassle-free replacement and repair of cable jumpers, cable connectors, splitters and phone jacks due to normal wear and tear.
  • Service calls due to customer education or customer owned equipment connected to your XFINITY services.
  • Confidence that if there is a problem with any XFINITY service, Comcast will take care of it without charging a service fee.
